 A BILL TO BE ENTITLED
 AN ACT
 relating to an abortion for a victim of incest or sexual assault.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 171.011, Health and Safety Code, is
 amended to read as follows:
 Sec. 171.011. INFORMED CONSENT REQUIRED. (a) A person may
 not perform an abortion without the voluntary and informed consent
 of the woman on whom the abortion is to be performed.
 (b)  If a pregnancy is the result of conduct constituting a
 felony, including incestuous sexual conduct prohibited by Section
 25.02, Penal Code, or sexual assault prohibited by Section 22.011
 or 22.021, Penal Code, a person may obtain the voluntary and
 informed consent of the woman without complying with this
 subchapter.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
