66 AN ACT
77 relating to an abortion for a victim of incest or sexual assault.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 171.011, Health and Safety Code, is
1010 amended to read as follows:
1111 Sec. 171.011. INFORMED CONSENT REQUIRED. (a) A person may
1212 not perform an abortion without the voluntary and informed consent
1313 of the woman on whom the abortion is to be performed.
1414 (b) If a pregnancy is the result of conduct constituting a
1515 felony, including incestuous sexual conduct prohibited by Section
1616 25.02, Penal Code, or sexual assault prohibited by Section 22.011
1717 or 22.021, Penal Code, a person may obtain the voluntary and
1818 informed consent of the woman without complying with this
1919 subchapter.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2009.
