| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 171.011, Health and Safety Code, is | |
| 10 | 10 | amended to read as follows: | |
| 11 | 11 | Sec. 171.011. INFORMED CONSENT REQUIRED. (a) A person may | |
| 12 | 12 | not perform an abortion without the voluntary and informed consent | |
| 13 | 13 | of the woman on whom the abortion is to be performed. | |
| 14 | 14 | (b) If a pregnancy is the result of conduct constituting a | |
| 15 | 15 | felony, including incestuous sexual conduct prohibited by Section | |
| 16 | 16 | 25.02, Penal Code, or sexual assault prohibited by Section 22.011 | |
| 17 | 17 | or 22.021, Penal Code, a person may obtain the voluntary and | |
| 18 | 18 | informed consent of the woman without complying with this | |
| 19 | 19 | subchapter. | |
| 20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2009. |
