8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 171.011, Health and Safety Code, is | |
10 | 10 | amended to read as follows: | |
11 | 11 | Sec. 171.011. INFORMED CONSENT REQUIRED. (a) A person may | |
12 | 12 | not perform an abortion without the voluntary and informed consent | |
13 | 13 | of the woman on whom the abortion is to be performed. | |
14 | 14 | (b) If a severe and irreversible abnormality in the fetus is | |
15 | 15 | detected, a person may obtain the voluntary and informed consent of | |
16 | 16 | the woman without complying with this subchapter. | |
17 | 17 | SECTION 2. This Act takes effect immediately if it receives | |
18 | 18 | a vote of two-thirds of all the members elected to each house, as | |
19 | 19 | provided by Section 39, Article III, Texas Constitution. If this | |
20 | 20 | Act does not receive the vote necessary for immediate effect, this | |
21 | 21 | Act takes effect September 1, 2009. |
