77 relating to an abortion when a fetal abnormality is detected.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 171.011, Health and Safety Code, is
1010 amended to read as follows:
1111 Sec. 171.011. INFORMED CONSENT REQUIRED. (a) A person may
1212 not perform an abortion without the voluntary and informed consent
1313 of the woman on whom the abortion is to be performed.
1414 (b) If a severe and irreversible abnormality in the fetus is
1515 detected, a person may obtain the voluntary and informed consent of
1616 the woman without complying with this subchapter.
1717 SECTION 2. This Act takes effect immediately if it receives
1818 a vote of two-thirds of all the members elected to each house, as
1919 provided by Section 39, Article III, Texas Constitution. If this
2020 Act does not receive the vote necessary for immediate effect, this
2121 Act takes effect September 1, 2009.
