| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 825.404(a), Government Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | (a) During each fiscal year, the state shall contribute to | |
| 13 | 13 | the retirement system an amount equal to at least seven [six] and | |
| 14 | 14 | not more than 10 percent of the aggregate annual compensation of all | |
| 15 | 15 | members of the retirement system during that fiscal year. The | |
| 16 | 16 | amount of the state contribution made under this section may not be | |
| 17 | 17 | less than the amount contributed by members during that fiscal year | |
| 18 | 18 | in accordance with Section 825.402. | |
| 19 | 19 | SECTION 2. Section 825.404(a), Government Code, as amended | |
| 20 | 20 | by this Act, applies beginning with the fiscal year that begins | |
| 21 | 21 | September 1, 2009. | |
| 22 | 22 | SECTION 3. This Act takes effect September 1, 2009. |
