| 10 | 10 | SECTION 1. Subchapter D, Chapter 109, Alcoholic Beverage | |
| 11 | 11 | Code, is amended by adding Section 109.5305 to read as follows: | |
| 12 | 12 | Sec. 109.5305. OWNERSHIP OF PERMIT FOR A BUILDING OWNED BY A | |
| 13 | 13 | MUNICIPALITY OR COUNTY. The provision of Section 109.53 or a rule | |
| 14 | 14 | adopted by the commission prohibiting subterfuge ownership of a | |
| 15 | 15 | license or permit or the premises covered by a license or permit | |
| 16 | 16 | does not apply to a facility owned by a municipality or county that | |
| 17 | 17 | is financed with public securities, the interest on which is exempt | |
| 18 | 18 | from federal income taxation under the Internal Revenue Code of | |
| 19 | 19 | 1986, or a license or permit issued for a premises at that facility. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2009. |
