A BILL TO BE ENTITLED AN ACT relating to an exemption from the structural pest control license requirement for certain falconers. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter B, Chapter 1951, Occupations Code, is amended by adding Section 1951.057 to read as follows: Sec. 1951.057. FALCONERS. (a) This chapter does not apply to a person engaged in falconry, as defined by Section 49.001, Parks and Wildlife Code, who: (1) is the holder of a falconer's permit as provided by Chapter 49, Parks and Wildlife Code; and (2) uses a raptor to control or relocate other birds. (b) A person described by Subsection (a) is not considered to be engaged in the business of structural pest control. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2009. * * * * *
