 A BILL TO BE ENTITLED
 AN ACT
 relating to the eligibility of school districts in certain counties
 to enter into agreements under the Texas Economic Development Act.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 313.051(a), Tax Code, is amended to read
 as follows:
 (a) This subchapter applies only to a school district that
 has territory in:
 (1) an area that qualified as a strategic investment
 area under Subchapter O, Chapter 171, immediately before that
 subchapter expired [, as defined by Section 171.721]; or
 (2) a county:
 (A) that has a population of less than 50,000;
 and
 (B) [that is not partially or wholly located in a
 metropolitan statistical area; and
 [(C)] in which, from 1990 to 2000, according to
 the federal decennial census, the population:
 (i) remained the same;
 (ii) decreased; or
 (iii) increased, but at a rate of not more
 than three percent per annum.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
