7 | 7 | | relating to the eligibility of school districts in certain counties |
---|
8 | 8 | | to enter into agreements under the Texas Economic Development Act. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 313.051(a), Tax Code, is amended to read |
---|
11 | 11 | | as follows: |
---|
12 | 12 | | (a) This subchapter applies only to a school district that |
---|
13 | 13 | | has territory in: |
---|
14 | 14 | | (1) an area that qualified as a strategic investment |
---|
15 | 15 | | area under Subchapter O, Chapter 171, immediately before that |
---|
16 | 16 | | subchapter expired [, as defined by Section 171.721]; or |
---|
17 | 17 | | (2) a county: |
---|
18 | 18 | | (A) that has a population of less than 50,000; |
---|
19 | 19 | | and |
---|
20 | 20 | | (B) [that is not partially or wholly located in a |
---|
21 | 21 | | metropolitan statistical area; and |
---|
22 | 22 | | [(C)] in which, from 1990 to 2000, according to |
---|
23 | 23 | | the federal decennial census, the population: |
---|
24 | 24 | | (i) remained the same; |
---|
25 | 25 | | (ii) decreased; or |
---|
26 | 26 | | (iii) increased, but at a rate of not more |
---|
27 | 27 | | than three percent per annum. |
---|
28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
---|
29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
---|
30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
---|
32 | 32 | | Act takes effect September 1, 2009. |
---|
