55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the award of certain municipal contracts.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 271.9051(a) and (b), Local Government
1010 Code, are amended to read as follows:
1111 (a) This section applies only to a municipality with a
1212 population of less than 250,000 that is [authorized under this
1313 title to purchase real property or personal property that is not
1414 affixed to real property.
1515 [(b) In] purchasing under this title:
1616 (1) [any] real property;
1717 (2) [,] personal property that is not affixed to real
1818 property; or
1919 (3) [, or] services, including services for the
2020 construction of a building, road, street, bridge, utility, or storm
2121 drainage facility.
2222 (b) If [if] a municipality receives one or more competitive
2323 sealed bids from a bidder whose principal place of business is in
2424 the municipality and whose bid is within five percent of the lowest
2525 bid price received by the municipality from a bidder who is not a
2626 resident of the municipality, the municipality may enter into a
2727 contract with:
2828 (1) the lowest bidder; or
2929 (2) the bidder whose principal place of business is in
3030 the municipality if the governing body of the municipality
3131 determines, in writing, that the local bidder offers the
3232 municipality the best combination of contract price and additional
3333 economic development opportunities for the municipality created by
3434 the contract award, including the employment of residents of the
3535 municipality and increased tax revenues to the municipality.
3636 SECTION 2. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2009.
