5 | 5 | | relating to the award of stipends to nationally certified classroom |

6 | 6 | | teachers under the educator excellence awards program. |

7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 21.705, Education Code, is amended to |
---|
9 | 9 | | read as follows: |
---|
10 | 10 | | Sec. 21.705. AWARD PAYMENTS. A school district must use at |
---|
11 | 11 | | least 60 percent of grant funds awarded to the district under this |
---|
12 | 12 | | subchapter to directly award classroom teachers who effectively |
---|
13 | 13 | | improve student achievement as determined by meaningful, objective |
---|
14 | 14 | | measures. The remaining funds must be used only to: |
---|
15 | 15 | | (1) provide stipends to effective mentors or teacher |
---|
16 | 16 | | coaches; |
---|
17 | 17 | | (2) provide stipends to classroom teachers who are |
---|
18 | 18 | | certified in a subject that is designated by the commissioner as |
---|
19 | 19 | | commonly experiencing a critical shortage of teachers; |
---|
20 | 20 | | (3) provide stipends to classroom teachers who are |
---|
21 | 21 | | certified under Subchapter B in the main subject area in which they |
---|
22 | 22 | | teach; |
---|
23 | 23 | | (4) provide stipends to classroom teachers with proven |
---|
24 | 24 | | records of success for improving student performance who are |
---|
25 | 25 | | assigned to campuses at which the district has experienced |
---|
26 | 26 | | difficulty assigning or retaining teachers; |
---|
27 | 27 | | (5) provide stipends to classroom teachers who hold |
---|
28 | 28 | | postgraduate degrees; |
---|
29 | 29 | | (6) provide stipends to classroom teachers who hold |
---|
30 | 30 | | advanced certification from an organization that certifies at least |
---|
31 | 31 | | 2,500 teachers in the United States each year based on the teachers' |
---|
32 | 32 | | satisfaction, through study, expert evaluation, self-assessment, |
---|
33 | 33 | | and peer review, of high and rigorous standards for accomplished |
---|
34 | 34 | | teaching; |
---|
35 | 35 | | (7) provide awards to principals who effectively |
---|
36 | 36 | | increase student performance as determined by objective measures; |
---|
37 | 37 | | (8) [(7)] provide awards to other campus employees who |
---|
38 | 38 | | demonstrate excellence; or |
---|
39 | 39 | | (9) [(8)] implement the components of a Teacher |
---|
40 | 40 | | Advancement Program (TAP), including: |
---|
41 | 41 | | (A) an instructionally focused accountability |
---|
42 | 42 | | system; and |
---|
43 | 43 | | (B) the adjustment of teaching schedules to |
---|
44 | 44 | | permit ongoing applied professional growth. |
---|
45 | 45 | | SECTION 2. This Act applies beginning with the 2009-2010 |
---|
46 | 46 | | school year. |
---|
47 | 47 | | SECTION 3. This Act takes effect immediately if it receives |
---|
48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
---|
49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
---|
51 | 51 | | Act takes effect September 1, 2009. |
