55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the penalties prescribed for committing prostitution
88 within a certain distance of certain designated places.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 43.01, Penal Code, is amended by adding
1111 Subdivisions (2-a) and (6) to read as follows:
1212 (2-a) "Protected premises" means the real property and
1313 all buildings and appurtenances pertaining to the real property of
1414 a:
1515 (A) church;
1616 (B) public or private school;
1717 (C) licensed child-care facility;
1818 (D) hotel, motel, or similar establishment;
1919 (E) public park;
2020 (F) premises of the holder of a license or permit
2121 issued under Title 3, Alcoholic Beverage Code; or
2222 (G) sexually oriented business.
2323 (6) "Sexually oriented business" has the meaning
2424 assigned by Section 243.002, Local Government Code.
2525 SECTION 2. Section 43.02, Penal Code, is amended by adding
2626 Subsection (d) to read as follows:
2727 (d) If it is shown on the trial of the offense that the actor
2828 committed the offense within 1,000 feet of a protected premises,
2929 the offense is:
3030 (1) a Class B misdemeanor with a minimum term of
3131 confinement of 90 days, if the offense would otherwise be
3232 punishable as a Class B misdemeanor under Subsection (c);
3333 (2) a Class A misdemeanor with a minimum term of
3434 confinement of 180 days, if the offense would otherwise be
3535 punishable as a Class A misdemeanor under Subsection (c); and
3636 (3) a state jail felony with a minimum term of
3737 confinement of one year, if the offense would otherwise be
3838 punishable as a state jail felony under Subsection (c).
3939 SECTION 3. Section 43.03(b), Penal Code, is amended to read
4040 as follows:
4141 (b) An offense under this section is a Class A misdemeanor,
4242 unless it is shown on the trial of the offense that the actor
4343 committed the offense within 1,000 feet of a protected premises, in
4444 which event the offense is a Class A misdemeanor with a minimum term
4545 of confinement of 180 days.
4646 SECTION 4. The change in law made by this Act applies only
4747 to an offense committed on or after the effective date of this Act.
4848 An offense committed before the effective date of this Act is
4949 covered by the law in effect when the offense was committed, and the
5050 former law is continued in effect for that purpose. For purposes of
5151 this section, an offense was committed before the effective date of
5252 this Act if any element of the offense was committed before that
5353 date.
5454 SECTION 5. This Act takes effect September 1, 2009.
