| 7 | 7 | | relating to the closure of a public school campus that is being used |

| 8 | 8 | | as an emergency evacuation shelter. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 38.025 to read as follows: |
|---|
| 12 | 12 | | Sec. 38.025. CAMPUS USED AS EMERGENCY EVACUATION SHELTER; |
|---|
| 13 | 13 | | CLOSURE REQUIRED. (a) A school district shall close a school |
|---|
| 14 | 14 | | campus used as an emergency evacuation shelter while the campus |
|---|
| 15 | 15 | | houses evacuees. |
|---|
| 16 | 16 | | (b) If a school is closed under this section, the |
|---|
| 17 | 17 | | commissioner shall reduce the number of days of instruction |
|---|
| 18 | 18 | | required under Section 25.081(a) by the number of instructional |
|---|
| 19 | 19 | | days the school is closed. |
|---|
| 20 | 20 | | SECTION 2. Section 25.081(a), Education Code, is amended to |
|---|
| 21 | 21 | | read as follows: |
|---|
| 22 | 22 | | (a) Except as authorized under Subsection (b) of this |
|---|
| 23 | 23 | | section, Section 25.084, [or] Section 29.0821, or Section 38.025, |
|---|
| 24 | 24 | | for each school year each school district must operate so that the |
|---|
| 25 | 25 | | district provides for at least 180 days of instruction for |
|---|
| 26 | 26 | | students. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
