55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the closure of a public school campus that is being used
88 as an emergency evacuation shelter.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1111 amended by adding Section 38.025 to read as follows:
1212 Sec. 38.025. CAMPUS USED AS EMERGENCY EVACUATION SHELTER;
1313 CLOSURE REQUIRED. (a) A school district shall close a school
1414 campus used as an emergency evacuation shelter while the campus
1515 houses evacuees.
1616 (b) If a school is closed under this section, the
1717 commissioner shall reduce the number of days of instruction
1818 required under Section 25.081(a) by the number of instructional
1919 days the school is closed.
2020 SECTION 2. Section 25.081(a), Education Code, is amended to
2121 read as follows:
2222 (a) Except as authorized under Subsection (b) of this
2323 section, Section 25.084, [or] Section 29.0821, or Section 38.025,
2424 for each school year each school district must operate so that the
2525 district provides for at least 180 days of instruction for
2626 students.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2009.
