| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 542.401, Transportation Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | Sec. 542.401. GENERAL PENALTY. A person convicted of an | |
| 13 | 13 | offense that is a misdemeanor under this subtitle for which another | |
| 14 | 14 | penalty is not provided shall be punished by a fine of not less than | |
| 15 | 15 | $1 or more than $500 [$200]. | |
| 16 | 16 | SECTION 2. The change in law made by this Act applies only | |
| 17 | 17 | to an offense committed on or after the effective date of this Act. | |
| 18 | 18 | An offense committed before the effective date of this Act is | |
| 19 | 19 | covered by the law in effect when the offense was committed. For | |
| 20 | 20 | purposes of this section, an offense was committed before the | |
| 21 | 21 | effective date of this Act if any element of the offense occurred | |
| 22 | 22 | before that date. | |
| 23 | 23 | SECTION 3. This Act takes effect September 1, 2009. |
