| 7 | 7 | relating to the definition of a police vehicle for the purposes of | |
| 8 | 8 | certain traffic laws. | |
| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 541.201(13-a), Transportation Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (13-a) "Police vehicle" means a vehicle [of a | |
| 13 | 13 | governmental entity] primarily used by a peace officer, as defined | |
| 14 | 14 | by Article 2.12, Code of Criminal Procedure, for law enforcement | |
| 15 | 15 | purposes that: | |
| 16 | 16 | (A) is owned or leased by a governmental entity; | |
| 17 | 17 | or | |
| 18 | 18 | (B) is: | |
| 19 | 19 | (i) a private vehicle owned or leased by the | |
| 20 | 20 | peace officer; and | |
| 21 | 21 | (ii) approved for use for law enforcement | |
| 22 | 22 | purposes by the head of the law enforcement agency that employs the | |
| 23 | 23 | peace officer, or by that person's designee. | |
| 24 | 24 | SECTION 2. This Act takes effect immediately if it receives | |
| 25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
| 26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
| 27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
| 28 | 28 | Act takes effect September 1, 2009. |
