55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the penalty for an offense committed during the
88 inattentive operation of a motor vehicle.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 542, Transportation Code,
1111 is amended by adding Section 542.408 to read as follows:
1212 Sec. 542.408. INATTENTIVE DRIVING; FINE FOR OFFENSE. (a)
1313 An offense under this subtitle is punishable by a fine that is at
1414 least twice the minimum fine applicable to the offense and not more
1515 than twice the maximum fine that is applicable to the offense if the
1616 person who commits the offense is at the time of the offense
1717 operating a motor vehicle while:
1818 (1) reading;
1919 (2) writing;
2020 (3) performing personal grooming;
2121 (4) consuming food or a beverage;
2222 (5) interacting with a pet;
2323 (6) interacting with a vehicle passenger;
2424 (7) using a personal communications device; or
2525 (8) engaging in another activity that prevents the
2626 operator from safely operating the motor vehicle.
2727 (b) For the purposes of this section:
2828 (1) "Personal grooming" includes:
2929 (A) applying makeup;
3030 (B) shaving;
3131 (C) combing hair; or
3232 (D) attending to another personal hygiene or
3333 appearance task.
3434 (2) "Personal communications device" includes:
3535 (A) a radio;
3636 (B) a personal stereo;
3737 (C) a compact disc player;
3838 (D) an audio or video device;
3939 (E) a personal computer;
4040 (F) a two-way radio, including a citizen's band
4141 radio;
4242 (G) a pager;
4343 (H) a telephone;
4444 (I) a wireless messaging device;
4545 (J) a facsimile machine;
4646 (K) a radar detector;
4747 (L) a personal digital assistant;
4848 (M) a geographic positioning system receiver; or
4949 (N) a similar device.
5050 SECTION 2. (a) The change in law made by this Act applies
5151 only to an offense committed on or after the effective date of this
5252 Act. For purposes of this section, an offense was committed before
5353 the effective date of this Act if any element of the offense
5454 occurred before that date.
5555 (b) An offense committed before the effective date of this
5656 Act is covered by the law in effect when the offense was committed,
5757 and the former law is continued in effect for that purpose.
5858 SECTION 3. This Act takes effect September 1, 2009.
