| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 25.0023, Government Code, is amended by |
|---|
| 9 | 9 | | amending Subsection (b) and adding Subsection (c) to read as |
|---|
| 10 | 10 | | follows: |
|---|
| 11 | 11 | | (b) Notwithstanding any other law and in addition to the |
|---|
| 12 | 12 | | judge's annual salary, the commissioners court annually shall pay a |
|---|
| 13 | 13 | | judge of a statutory probate court who has continuously served as a |
|---|
| 14 | 14 | | judge of a statutory probate court or a statutory county court since |
|---|
| 15 | 15 | | August 31, 1995, an additional amount equal to the amount of benefit |
|---|
| 16 | 16 | | replacement pay a district judge is entitled to receive from the |
|---|
| 17 | 17 | | state under Subchapter H, Chapter 659, for equivalent continuous |
|---|
| 18 | 18 | | service [The salary shall be paid in equal monthly installments]. |
|---|
| 19 | 19 | | (c) The commissioners court monthly shall pay a statutory |
|---|
| 20 | 20 | | probate court judge who has served as a judge of a statutory probate |
|---|
| 21 | 21 | | court or a statutory county court for at least 16 years longevity |
|---|
| 22 | 22 | | pay in an amount equal to the amount of longevity pay a district |
|---|
| 23 | 23 | | judge is entitled to receive from the state for equivalent years of |
|---|
| 24 | 24 | | service. The longevity pay is in addition to the judge's monthly |
|---|
| 25 | 25 | | salary. |
|---|
| 26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2009. |
