66 AN ACT
77 relating to the boards of trustees of retirement systems for paid or
88 partly paid firefighters.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 19(a), Texas Local Fire Fighters
1111 Retirement Act (Article 6243e, Vernon's Texas Civil Statutes), is
1212 amended to read as follows:
1313 (a) In each municipality and other political subdivision to
1414 which this Act applies and that has a fire department that does not
1515 consist exclusively of volunteers, the fire fighters' retirement
1616 system is governed by a board of trustees consisting of:
1717 (1) the mayor of the municipality or the mayor's
1818 designated representative or the chief operating officer of the
1919 political subdivision or the chief operating officer's designated
2020 representative, as applicable;
2121 (2) the chief financial officer of the municipality or
2222 other political subdivision or, if there is no officer denominated
2323 as chief financial officer, the person who performs the duties of
2424 chief financial officer or a person designated by the chief
2525 financial officer or by the person performing the duties of chief
2626 financial officer;
2727 (3) three members of the retirement system elected by
2828 participating members as provided by Subsection (b) of this
2929 section; and
3030 (4) two persons, at least one of whom is a retiree,
3131 who:
3232 (A) reside in this state in the municipality or
3333 other political subdivision or within the extraterritorial
3434 jurisdiction of the municipality;
3535 (B) [, who] are not officers or employees of the
3636 municipality or other political subdivision;[,] and
3737 (C) [who] are elected by a majority vote of the
3838 members of the board of trustees determined as provided by
3939 Subdivisions (1), (2), and (3) of this subsection.
4040 SECTION 2. (a) The change in law made by this Act in the
4141 qualifications of certain trustees of the boards of trustees of
4242 retirement systems for paid or partly paid firefighters does not
4343 affect the entitlement of a trustee serving on a board immediately
4444 before the effective date of this Act to continue to carry out the
4545 board's functions for the remainder of the trustee's term. The
4646 change in law applies only to a trustee elected on or after the
4747 effective date of this Act.
4848 (b) On or after the effective date of this Act, as the terms
4949 of trustees of the boards of trustees of retirement systems for paid
5050 or partly paid firefighters expire or as vacancies occur, the
5151 boards shall appoint trustees so that the boards are composed in
5252 accordance with Section 19(a), Texas Local Fire Fighters Retirement
5353 Act (Article 6243e, Vernon's Texas Civil Statutes), as amended by
5454 this Act.
5555 SECTION 3. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2009.
