6	6	AN ACT
7	7	relating to the boards of trustees of retirement systems for paid or
8	8	partly paid firefighters.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 19(a), Texas Local Fire Fighters
11	11	Retirement Act (Article 6243e, Vernon's Texas Civil Statutes), is
12	12	amended to read as follows:
13	13	(a) In each municipality and other political subdivision to
14	14	which this Act applies and that has a fire department that does not
15	15	consist exclusively of volunteers, the fire fighters' retirement
16	16	system is governed by a board of trustees consisting of:
17	17	(1) the mayor of the municipality or the mayor's
18	18	designated representative or the chief operating officer of the
19	19	political subdivision or the chief operating officer's designated
20	20	representative, as applicable;
21	21	(2) the chief financial officer of the municipality or
22	22	other political subdivision or, if there is no officer denominated
23	23	as chief financial officer, the person who performs the duties of
24	24	chief financial officer or a person designated by the chief
25	25	financial officer or by the person performing the duties of chief
26	26	financial officer;
27	27	(3) three members of the retirement system elected by
28	28	participating members as provided by Subsection (b) of this
29	29	section; and
30	30	(4) two persons, at least one of whom is a retiree,
31	31	who:
32	32	(A) reside in this state in the municipality or
33	33	other political subdivision or within the extraterritorial
34	34	jurisdiction of the municipality;
35	35	(B) [, who] are not officers or employees of the
36	36	municipality or other political subdivision;[,] and
37	37	(C) [who] are elected by a majority vote of the
38	38	members of the board of trustees determined as provided by
39	39	Subdivisions (1), (2), and (3) of this subsection.
40	40	SECTION 2. (a) The change in law made by this Act in the
41	41	qualifications of certain trustees of the boards of trustees of
42	42	retirement systems for paid or partly paid firefighters does not
43	43	affect the entitlement of a trustee serving on a board immediately
44	44	before the effective date of this Act to continue to carry out the
45	45	board's functions for the remainder of the trustee's term. The
46	46	change in law applies only to a trustee elected on or after the
47	47	effective date of this Act.
48	48	(b) On or after the effective date of this Act, as the terms
49	49	of trustees of the boards of trustees of retirement systems for paid
50	50	or partly paid firefighters expire or as vacancies occur, the
51	51	boards shall appoint trustees so that the boards are composed in
52	52	accordance with Section 19(a), Texas Local Fire Fighters Retirement
53	53	Act (Article 6243e, Vernon's Texas Civil Statutes), as amended by
54	54	this Act.
55	55	SECTION 3. This Act takes effect immediately if it receives
56	56	a vote of two-thirds of all the members elected to each house, as
57	57	provided by Section 39, Article III, Texas Constitution. If this
58	58	Act does not receive the vote necessary for immediate effect, this
59	59	Act takes effect September 1, 2009.
