| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 65.054, Election Code, is amended by | |
| 11 | 11 | adding Subsection (e) to read as follows: | |
| 12 | 12 | (e) For a provisional ballot cast outside the precinct in | |
| 13 | 13 | which a voter resides, the board shall accept the ballot of a voter | |
| 14 | 14 | who is registered to vote in this state but only count a vote cast | |
| 15 | 15 | for: | |
| 16 | 16 | (1) an office or proposition stating a measure for | |
| 17 | 17 | which a statewide election was held; and | |
| 18 | 18 | (2) an office or proposition stating a measure in a | |
| 19 | 19 | territorial unit of which the voter was entitled to vote at the | |
| 20 | 20 | voter's registered address. | |
| 21 | 21 | SECTION 2. This Act takes effect September 1, 2009. |
