99 AN ACT
1010 relating to the period during which certain energy-efficient
1111 products are exempt from the sales tax.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 151.333(c), Tax Code, is amended to read
1414 as follows:
1515 (c) The sale of an energy-efficient product to which this
1616 section applies is exempted from the taxes imposed by this chapter
1717 if the sale takes place:
1818 (1) during a period beginning at 12:01 a.m. on the
1919 Saturday preceding the last Monday in May (Memorial Day) and ending
2020 at 11:59 p.m. on the last Monday in May; or
2121 (2) during a period beginning at 12:01 a.m. on the
2222 first Monday in September (Labor Day) and ending at 11:59 p.m. on
2323 the first Monday in September.
2424 SECTION 2. The change in law made by this Act does not
2525 affect taxes imposed before the effective date of this Act, and the
2626 law in effect before the effective date of this Act is continued in
2727 effect for purposes of the liability for and collection of those
2828 taxes.
2929 SECTION 3. This Act takes effect July 1, 2009, if it
3030 receives a vote of two-thirds of all the members elected to each
3131 house, as provided by Section 39, Article III, Texas Constitution.
3232 If this Act does not receive the vote necessary for effect on that
3333 date, this Act takes effect October 1, 2009.
