77 relating to granting limited state law enforcement authority to
88 commissioned law enforcement officers of the United States Fish and
99 Wildlife Service.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 2.122, Code of Criminal Procedure, is
1212 amended by adding Subsection (h) to read as follows:
1313 (h) A commissioned law enforcement officer of the United
1414 States Fish and Wildlife Service is not a peace officer under the
1515 laws of this state, except that the officer has the powers of
1616 arrest, search, and seizure as to any offense under the laws of this
1717 state committed within the boundaries of the National Wildlife
1818 Refuge System. In this subsection, "National Wildlife Refuge
1919 System" has the meaning assigned by 16 U.S.C. Section 668dd.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2009.
