10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Article 2.122, Code of Criminal Procedure, is | |
12 | 12 | amended by adding Subsection (h) to read as follows: | |
13 | 13 | (h) A commissioned law enforcement officer of the United | |
14 | 14 | States Fish and Wildlife Service is not a peace officer under the | |
15 | 15 | laws of this state, except that the officer has the powers of | |
16 | 16 | arrest, search, and seizure as to any offense under the laws of this | |
17 | 17 | state committed within the boundaries of the National Wildlife | |
18 | 18 | Refuge System. In this subsection, "National Wildlife Refuge | |
19 | 19 | System" has the meaning assigned by 16 U.S.C. Section 668dd. | |
20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
24 | 24 | Act takes effect September 1, 2009. |
