55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring a candidate for public office to provide
88 proof of citizenship.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 141.031(a), Election Code, is amended to
1111 read as follows:
1212 (a) A candidate's application for a place on the ballot that
1313 is required by this code must:
1414 (1) be in writing;
1515 (2) be signed and sworn to by the candidate and
1616 indicate the date that the candidate swears to the application;
1717 (3) be timely filed with the appropriate authority;
1818 and
1919 (4) include:
2020 (A) the candidate's name;
2121 (B) the candidate's occupation;
2222 (C) the office sought, including any place number
2323 or other distinguishing number;
2424 (D) an indication of whether the office sought is
2525 to be filled for a full or unexpired term if the office sought and
2626 another office to be voted on have the same title but do not have
2727 place numbers or other distinguishing numbers;
2828 (E) a statement that the candidate is a United
2929 States citizen;
3030 (F) a statement that the candidate has not been
3131 determined by a final judgment of a court exercising probate
3232 jurisdiction to be:
3333 (i) totally mentally incapacitated; or
3434 (ii) partially mentally incapacitated
3535 without the right to vote;
3636 (G) a statement that the candidate has not been
3737 finally convicted of a felony from which the candidate has not been
3838 pardoned or otherwise released from the resulting disabilities;
3939 (H) the candidate's date of birth;
4040 (I) the candidate's residence address or, if the
4141 residence has no address, the address at which the candidate
4242 receives mail and a concise description of the location of the
4343 candidate's residence;
4444 (J) the candidate's length of continuous
4545 residence in the state and in the territory from which the office
4646 sought is elected as of the date the candidate swears to the
4747 application;
4848 (K) the statement: "I, __________, of
4949 __________ County, Texas, being a candidate for the office of
5050 __________, swear that I will support and defend the constitution
5151 and laws of the United States and of the State of Texas"; [and]
5252 (L) a statement that the candidate is aware of
5353 the nepotism law, Chapter 573, Government Code; and
5454 (M) proof of the candidate's United States
5555 citizenship through a certified copy of a birth certificate or
5656 other document that establishes citizenship in a form prescribed by
5757 the secretary of state.
5858 SECTION 2. The change in law made by this Act applies only
5959 to a candidate's application for a place on the ballot that is filed
6060 on or after the effective date of this Act.
6161 SECTION 3. This Act takes effect September 1, 2009.
