55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the deadline for a school district to file a complaint
88 concerning a student who fails to attend school without excuse.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.0951(a), Education Code, as amended
1111 by Chapters 908 (H.B. 2884) and 984 (S.B. 1161), Acts of the 80th
1212 Legislature, Regular Session, 2007, is reenacted and amended to
1313 read as follows:
1414 (a) If a student fails to attend school without excuse on 10
1515 or more days or parts of days within a six-month period in the same
1616 school year, a school district shall within 14 [10] school days of
1717 the student's 10th absence:
1818 (1) file a complaint against the student or the
1919 student's parent or both in a county, justice, or municipal court
2020 for an offense under Section 25.093 or 25.094, as appropriate, or
2121 refer the student to a juvenile court in a county with a population
2222 of less than 100,000 for conduct that violates Section 25.094; or
2323 (2) refer the student to a juvenile court for conduct
2424 indicating a need for supervision under Section 51.03(b)(2), Family
2525 Code.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2009.
