7 | 7 | | relating to the deadline for a school district to file a complaint |

8 | 8 | | concerning a student who fails to attend school without excuse. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 25.0951(a), Education Code, as amended |
---|
11 | 11 | | by Chapters 908 (H.B. 2884) and 984 (S.B. 1161), Acts of the 80th |
---|
12 | 12 | | Legislature, Regular Session, 2007, is reenacted and amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (a) If a student fails to attend school without excuse on 10 |
---|
15 | 15 | | or more days or parts of days within a six-month period in the same |
---|
16 | 16 | | school year, a school district shall within 14 [10] school days of |
---|
17 | 17 | | the student's 10th absence: |
---|
18 | 18 | | (1) file a complaint against the student or the |
---|
19 | 19 | | student's parent or both in a county, justice, or municipal court |
---|
20 | 20 | | for an offense under Section 25.093 or 25.094, as appropriate, or |
---|
21 | 21 | | refer the student to a juvenile court in a county with a population |
---|
22 | 22 | | of less than 100,000 for conduct that violates Section 25.094; or |
---|
23 | 23 | | (2) refer the student to a juvenile court for conduct |
---|
24 | 24 | | indicating a need for supervision under Section 51.03(b)(2), Family |
---|
25 | 25 | | Code. |
---|
26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2009. |
