88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 773, Health and Safety
1010 Code, is amended by adding Section 773.0415 to read as follows:
1111 Sec. 773.0415. LIMITATION ON INFORMATION REQUIRED FOR
1212 CERTIFICATE RENEWAL. The requirements and procedures adopted by
1313 the department for the renewal of a certificate to practice as
1414 emergency medical services personnel issued under this chapter:
1515 (1) may not require an applicant to provide unchanged
1616 criminal history information already included in one or more of the
1717 applicant's previous applications for certification or for
1818 certificate renewal filed with the department; and
1919 (2) may require the applicant to provide only
2020 information relevant to the period occurring since the date of the
2121 applicant's last application for certification or for certificate
2222 renewal, as applicable, including information relevant to any new
2323 requirement applicable to the certificate held by the applicant.
2424 SECTION 2. Subchapter G, Chapter 1701, Occupations Code, is
2525 amended by adding Section 1701.317 to read as follows:
2626 Sec. 1701.317. LIMITATION ON INFORMATION REQUIRED FOR
2727 LICENSE RENEWAL. The requirements and procedures adopted by the
2828 commission for the renewal of a license issued under this chapter:
2929 (1) may not require an applicant to provide unchanged
3030 criminal history information already included in one or more of the
3131 applicant's previous applications for licensure or for license
3232 renewal filed with the commission; and
3333 (2) may require the applicant to provide only
3434 information relevant to the period occurring since the date of the
3535 applicant's last application for licensure or for license renewal,
3636 as applicable, including information relevant to any new
3737 requirement applicable to the license held by the applicant.
3838 SECTION 3. Sections 773.0415, Health and Safety Code, and
3939 1701.317, Occupations Code, as added by this Act, apply only to a
4040 license or certificate renewed on or after January 1, 2011.
4141 SECTION 4. This Act takes effect September 1, 2009.
