| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter C, Chapter 773, Health and Safety |
|---|
| 10 | 10 | | Code, is amended by adding Section 773.0415 to read as follows: |
|---|
| 11 | 11 | | Sec. 773.0415. LIMITATION ON INFORMATION REQUIRED FOR |
|---|
| 12 | 12 | | CERTIFICATE RENEWAL. The requirements and procedures adopted by |
|---|
| 13 | 13 | | the department for the renewal of a certificate to practice as |
|---|
| 14 | 14 | | emergency medical services personnel issued under this chapter: |
|---|
| 15 | 15 | | (1) may not require an applicant to provide unchanged |
|---|
| 16 | 16 | | criminal history information already included in one or more of the |
|---|
| 17 | 17 | | applicant's previous applications for certification or for |
|---|
| 18 | 18 | | certificate renewal filed with the department; and |
|---|
| 19 | 19 | | (2) may require the applicant to provide only |
|---|
| 20 | 20 | | information relevant to the period occurring since the date of the |
|---|
| 21 | 21 | | applicant's last application for certification or for certificate |
|---|
| 22 | 22 | | renewal, as applicable, including information relevant to any new |
|---|
| 23 | 23 | | requirement applicable to the certificate held by the applicant. |

| 24 | 24 | | SECTION 2. Subchapter G, Chapter 1701, Occupations Code, is |
|---|
| 25 | 25 | | amended by adding Section 1701.317 to read as follows: |
|---|
| 26 | 26 | | Sec. 1701.317. LIMITATION ON INFORMATION REQUIRED FOR |
|---|
| 27 | 27 | | LICENSE RENEWAL. The requirements and procedures adopted by the |
|---|
| 28 | 28 | | commission for the renewal of a license issued under this chapter: |
|---|
| 29 | 29 | | (1) may not require an applicant to provide unchanged |
|---|
| 30 | 30 | | criminal history information already included in one or more of the |
|---|
| 31 | 31 | | applicant's previous applications for licensure or for license |
|---|
| 32 | 32 | | renewal filed with the commission; and |
|---|
| 33 | 33 | | (2) may require the applicant to provide only |
|---|
| 34 | 34 | | information relevant to the period occurring since the date of the |
|---|
| 35 | 35 | | applicant's last application for licensure or for license renewal, |
|---|
| 36 | 36 | | as applicable, including information relevant to any new |
|---|
| 37 | 37 | | requirement applicable to the license held by the applicant. |

| 38 | 38 | | SECTION 3. Sections 773.0415, Health and Safety Code, and |
|---|
| 39 | 39 | | 1701.317, Occupations Code, as added by this Act, apply only to a |
|---|
| 40 | 40 | | license or certificate renewed on or after January 1, 2011. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect September 1, 2009. |
