88 AN ACT
99 relating to nonpayment of hospitals under the state Medicaid
1010 program for certain preventable adverse conditions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1313 is amended by adding Section 32.02805 to read as follows:
1414 Sec. 32.02805. NONPAYMENT OF HOSPITALS FOR PREVENTABLE
1515 ADVERSE CONDITIONS. (a) The department in its adoption of
1616 reasonable rules and standards governing the determination of rates
1717 paid for inpatient hospital services on a prospective payment basis
1818 shall assure that a hospital may not receive additional payment
1919 associated with any of the following preventable adverse conditions
2020 involving a recipient of medical assistance during the recipient's
2121 hospitalization:
2222 (1) a foreign object retained after surgery;
2323 (2) surgery performed on the wrong body part;
2424 (3) surgery performed on the wrong person;
2525 (4) the wrong surgical procedure performed on the
2626 recipient;
2727 (5) intravascular air embolism;
2828 (6) blood or blood product incompatibility;
2929 (7) a stage three or four pressure ulcer;
3030 (8) a fall or trauma resulting in a fracture,
3131 dislocation, intracranial injury, or crushing injury;
3232 (9) a burn or electric shock;
3333 (10) a catheter-associated urinary tract infection;
3434 (11) a vascular catheter-associated infection;
3535 (12) a manifestation of poor glycemic control,
3636 including diabetic ketoacidosis, nonketotic hyperosmolar coma,
3737 hypoglycemic coma, secondary diabetes with ketoacidosis, and
3838 secondary diabetes with hyperosmolarity;
3939 (13) a surgical site infection or mediastinitis
4040 following a coronary artery bypass graft;
4141 (14) a surgical site infection following certain
4242 orthopedic procedures of the spine, neck, shoulder, or elbow;
4343 (15) a surgical site infection following bariatric
4444 surgery for obesity, including laparoscopic gastric bypass
4545 surgery, gastroenterostomy, and laparoscopic gastric restrictive
4646 surgery; and
4747 (16) deep vein thrombosis and pulmonary embolism
4848 following certain orthopedic procedures, including total knee
4949 replacement or hip replacement.
5050 (b) The executive commissioner of the Health and Human
5151 Services Commission may adopt rules to define additional
5252 preventable adverse conditions for which a hospital shall be denied
5353 additional payment under this section. In adopting rules under
5454 this subsection, the executive commissioner may consider only the
5555 same types of health care-associated adverse conditions or events
5656 for which the Medicare program will not provide additional payment
5757 under a policy adopted by the Centers for Medicare and Medicaid
5858 Services.
5959 (c) The department's nonpayment of a hospital under this
6060 section does not in itself create civil liability and is not subject
6161 to discovery or admissible in any civil action against the
6262 hospital.
6363 (d) The Health and Human Services Commission shall compile
6464 information regarding the denial of payment to hospitals under this
6565 section.
6666 (e) The Health and Human Services Commission shall make
6767 statistical information derived from the data compiled under
6868 Subsection (d) readily available in a user-friendly format on the
6969 commission's website.
7070 (f) The Health and Human Services Commission may not provide
7171 information under Subsection (e) in a manner that identifies a
7272 recipient of medical assistance.
7373 SECTION 2. Not later than November 1, 2009, the executive
7474 commissioner of the Health and Human Services Commission shall
7575 adopt rules necessary to implement Section 32.02805, Human
7676 Resources Code, as added by this Act.
7777 SECTION 3. Section 32.02805, Human Resources Code, as added
7878 by this Act, applies only to a preventable adverse condition
7979 occurring on or after the effective date of the rules adopted by the
8080 executive commissioner of the Health and Human Services Commission
8181 under Section 2 of this Act.
8282 SECTION 4. If before implementing any provision of this Act
8383 a state agency determines that a waiver or authorization from a
8484 federal agency is necessary for implementation of that provision,
8585 the agency affected by the provision shall request the waiver or
8686 authorization and may delay implementing that provision until the
8787 waiver or authorization is granted.
8888 SECTION 5. This Act takes effect September 1, 2009.
