| 7 | 7 | | relating to the authority of certain university systems to provide |

| 8 | 8 | | benefits to certain qualified individuals. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1601.107, Insurance Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 1601.107. COVERAGE FOR DEPENDENTS AND OTHER QUALIFIED |
|---|
| 13 | 13 | | INDIVIDUALS. (a) An individual who is eligible to participate in |
|---|
| 14 | 14 | | the uniform program under Section 1601.101 or 1601.102 is entitled |
|---|
| 15 | 15 | | to secure for a dependent of the individual, or for another |
|---|
| 16 | 16 | | qualified individual, any group coverages provided under this |
|---|
| 17 | 17 | | chapter for dependents under rules adopted by the applicable |
|---|
| 18 | 18 | | system. |
|---|
| 19 | 19 | | (b) For purposes of this section, "qualified individual" |
|---|
| 20 | 20 | | has the meaning assigned by any applicable rule adopted by a system. |
|---|
| 21 | 21 | | SECTION 2. This Act applies only to an insurance policy that |
|---|
| 22 | 22 | | is delivered, issued for delivery, or renewed on or after January 1, |
|---|
| 23 | 23 | | 2010. A policy delivered, issued for delivery, or renewed before |
|---|
| 24 | 24 | | January 1, 2010, is governed by the law in effect when the policy |
|---|
| 25 | 25 | | was delivered, issued for delivery, or renewed, and that law is |
|---|
| 26 | 26 | | continued in effect for that purpose. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2009. |
