5	5	relating to the transfer of certain state property from the Texas
6	6	Department of Criminal Justice to the City of Burnet.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. (a) Not later than September 30, 2009, the Texas
9	9	Department of Criminal Justice shall transfer to the City of Burnet
10	10	the real property described by Subsection (e) of this section.
11	11	(b) The City of Burnet shall use the property transferred
12	12	under this Act only for a purpose that benefits the public interest
13	13	of the state. If the City of Burnet uses the property for any
14	14	purpose other than a purpose that benefits the public interest of
15	15	the state, ownership of the property automatically reverts to the
16	16	Texas Department of Criminal Justice.
17	17	(c) The Texas Department of Criminal Justice shall transfer
18	18	the property by an appropriate instrument of transfer. The
19	19	instrument of transfer must:
20	20	(1) provide that:
21	21	(A) the City of Burnet use the property only for a
22	22	purpose that benefits the public interest of the state; and
23	23	(B) ownership of the property will automatically
24	24	revert to the Texas Department of Criminal Justice if the City of
25	25	Burnet uses the property for any purpose other than a purpose that
26	26	benefits the public interest of the state; and
27	27	(2) describe the property to be transferred by metes
28	28	and bounds.
29	29	(d) The Texas Department of Criminal Justice shall retain
30	30	custody of the instrument of transfer after the instrument of
31	31	transfer is filed in the real property records of Burnet County.
32	32	(e) The real property referred to in this section is
33	33	described as follows:
34	34	BEING A 2.259 ACRE TRACT OF LAND, OUT OF THE EUGENIO PEREZ SURVEY
35	35	NO. 41, ABSTRACT NO. 672, SITUATED IN BURNET COUNTY, TEXAS, AND
36	36	BEING A PORTION OF A CALLED 300.000 ACRE TRACT OF LAND, DESCRIBED IN
37	37	A DEED TO THE STATE OF TEXAS DEPARTMENT OF CRIMINAL JUSTICE, AS
38	38	RECORDED IN VOLUME 609, PAGE 19 OF THE REAL PROPERTY RECORDS OF
39	39	BURNET COUNTY, TEXAS (R.P.R.B.C.T.), SAID 2.259 ACRES OF LAND,
40	40	BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS.
41	41	BEGINNING at a 5/8-inch iron rod found along a westerly line of the
42	42	remaining portion of a called 79.31 acre tract of land, described in
43	43	a deed to the City of Burnet, as recorded in Volume 124, Page 112 of
44	44	the Deed Records of Burnet County, Texas (D.R.B.C.T.), for the
45	45	north corner of a called 1.639 acre tract of land, described in a
46	46	deed to the City of Burnet, as recorded in Volume 300, Page 180
47	47	D.R.B.C.T., the most easterly southeast corner of said 300.000 acre
48	48	tract and the most easterly southeast corner hereof;
49	49	THENCE South 1524'56" West (S1606'15"W), along a northwesterly
50	50	line of said 1.639 acre tract, an easterly line of said 300.000 acre
51	51	tract and an easterly line hereof, a distance of 67.61 feet (67.80')
52	52	to a 5/8-inch iron rod found, for the northeast corner of a called
53	53	19.737 acre tract of land, described in a deed to Big Leaf LTD., as
54	54	recorded in Volume 618, Page 569 R.P.R.B.C.T., the southeast corner
55	55	of said 300.00 acre tract and the southeast corner hereof, from
56	56	which a 5/8-inch iron rod found, for the southeast corner of said
57	57	19.737 acre tract, bears South 1503'42" West, a distance of 530.79
58	58	feet;
59	59	THENCE South 7551'25" West (S7652'35"W), along a northerly line of
60	60	said 19.737 acre tract, a southerly line of said 300.000 acre tract
61	61	and the southerly line hereof, a distance of 255.72 feet, to a
62	62	1/2-inch iron rod set with "CUPLIN" property cap, for the southwest
63	63	corner hereof;
64	64	THENCE North 1408'35" West, over and across said 300.000 acre
65	65	tract, for the westerly line hereof, a distance of 345.10 feet, to a
66	66	5/8-inch iron rod found, for the southwest corner of a called 20.611
67	67	acre tract of land (Tract II), described in a deed to the City of
68	68	Burnet, as recorded in Volume 300, Page 184 D.R.B.C.T., an interior
69	69	corner of said 300.000 acre tract and the northwest corner hereof;
70	70	THENCE North 7632'34" East (N7729'40"E), along a southerly line of
71	71	said 20.611 acre tract, a northerly line of said 300.000 acre tract
72	72	and the northerly line hereof, a distance of 290.24 feet (290.24'),
73	73	to a 5/8-inch iron rod found, along a westerly line of said
74	74	remainder of 79.31 acres, for southeast corner of said 20.611 acre
75	75	tract, an easterly corner of said 300.000 acre tract and the
76	76	northeast corner hereof;
77	77	THENCE South 1344'38" East (S1239'31"E), along a westerly line of
78	78	said remainder of 79.31 acre tract, an easterly line of said 300.000
79	79	acre tract, for the easterly line hereof, a distance of 282.82 feet
80	80	(282.78'), to the POINT OF BEGINNING, containing 2.259 acres, more
81	81	or less.
82	82	(f) The City of Burnet shall pay any transaction fees
83	83	resulting from the transfer of property under this Act.
84	84	SECTION 2. This Act takes effect immediately if it receives
85	85	a vote of two-thirds of all the members elected to each house, as
86	86	provided by Section 39, Article III, Texas Constitution. If this
87	87	Act does not receive the vote necessary for immediate effect, this
88	88	Act takes effect September 1, 2009.
