| 7 | 7 | | relating to the stopping, standing, or parking of certain vehicles |

| 8 | 8 | | on a highway. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 545.301(b), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b) This section does not apply to an operator of: |
|---|
| 13 | 13 | | (1) a vehicle that is disabled while on the paved or |
|---|
| 14 | 14 | | main traveled part of a highway if it is impossible to avoid |
|---|
| 15 | 15 | | stopping and temporarily leaving the vehicle on the highway; |
|---|
| 16 | 16 | | (2) a vehicle owned by the Texas Department of |
|---|
| 17 | 17 | | Transportation, a county, a municipality, or another political |
|---|
| 18 | 18 | | subdivision of this state operated at the time in connection with |
|---|
| 19 | 19 | | the construction, maintenance, or repair of the highway; |
|---|
| 20 | 20 | | (3) a vehicle owned by a public or private electric, |
|---|
| 21 | 21 | | water, sewer, natural gas, solid waste disposal, or drainage |
|---|
| 22 | 22 | | utility operated at the time in connection with the construction, |
|---|
| 23 | 23 | | maintenance, or repair of property or a facility of the utility; |
|---|
| 24 | 24 | | (4) a vehicle used exclusively to transport solid, |
|---|
| 25 | 25 | | semisolid, or liquid waste operated at the time in connection with |
|---|
| 26 | 26 | | the removal or transportation of solid, semisolid, or liquid waste |
|---|
| 27 | 27 | | from a location adjacent to the highway; |
|---|
| 28 | 28 | | (5) a tow truck, as defined by Section 504.508, |
|---|
| 29 | 29 | | operated at the time in connection with the removal from the highway |
|---|
| 30 | 30 | | of a vehicle described by Subdivision (1); |
|---|
| 31 | 31 | | (6) a vehicle owned by the United States Postal |
|---|
| 32 | 32 | | Service or any other person operated at the time in connection with |
|---|
| 33 | 33 | | the delivery of mail; |
|---|
| 34 | 34 | | (7) a vehicle owned by a commercial courier operated |
|---|
| 35 | 35 | | at the time in connection with the delivery of parcels; |
|---|
| 36 | 36 | | (8) a vehicle owned by a telecommunications provider, |
|---|
| 37 | 37 | | as defined by Section 51.002, Utilities Code, operated at the time |
|---|
| 38 | 38 | | in connection with the construction, maintenance, or repair of |
|---|
| 39 | 39 | | property or a facility of the provider; or |
|---|
| 40 | 40 | | (9) a vehicle owned by a cable service provider or a |
|---|
| 41 | 41 | | video service provider, as defined by Section 66.002, Utilities |
|---|
| 42 | 42 | | Code, operated at the time in connection with the construction, |
|---|
| 43 | 43 | | maintenance, or repair of property or a facility of the provider. |
|---|
| 44 | 44 | | SECTION 2. This Act takes effect September 1, 2009. |
