77 relating to the stopping, standing, or parking of certain vehicles
88 on a highway.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 545.301(b), Transportation Code, is
1111 amended to read as follows:
1212 (b) This section does not apply to an operator of:
1313 (1) a vehicle that is disabled while on the paved or
1414 main traveled part of a highway if it is impossible to avoid
1515 stopping and temporarily leaving the vehicle on the highway;
1616 (2) a vehicle owned by the Texas Department of
1717 Transportation, a county, a municipality, or another political
1818 subdivision of this state operated at the time in connection with
1919 the construction, maintenance, or repair of the highway;
2020 (3) a vehicle owned by a public or private electric,
2121 water, sewer, natural gas, solid waste disposal, or drainage
2222 utility operated at the time in connection with the construction,
2323 maintenance, or repair of property or a facility of the utility;
2424 (4) a vehicle used exclusively to transport solid,
2525 semisolid, or liquid waste operated at the time in connection with
2626 the removal or transportation of solid, semisolid, or liquid waste
2727 from a location adjacent to the highway;
2828 (5) a tow truck, as defined by Section 504.508,
2929 operated at the time in connection with the removal from the highway
3030 of a vehicle described by Subdivision (1);
3131 (6) a vehicle owned by the United States Postal
3232 Service or any other person operated at the time in connection with
3333 the delivery of mail;
3434 (7) a vehicle owned by a commercial courier operated
3535 at the time in connection with the delivery of parcels;
3636 (8) a vehicle owned by a telecommunications provider,
3737 as defined by Section 51.002, Utilities Code, operated at the time
3838 in connection with the construction, maintenance, or repair of
3939 property or a facility of the provider; or
4040 (9) a vehicle owned by a cable service provider or a
4141 video service provider, as defined by Section 66.002, Utilities
4242 Code, operated at the time in connection with the construction,
4343 maintenance, or repair of property or a facility of the provider.
4444 SECTION 2. This Act takes effect September 1, 2009.
