5	5	relating to the abolition of the Texas Incentive and Productivity
6	6	Commission and the state employee incentive program.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. AMENDMENT. The heading to Chapter 2108,
9	9	Government Code, is amended to read as follows:
10	10	CHAPTER 2108. SAVINGS [EMPLOYEE] INCENTIVE PROGRAM FOR STATE [AND]
11	11	AGENCY [PRODUCTIVITY]
12	12	SECTION 2. REPEALER. (a) Subchapters A and B, Chapter
13	13	2108, Government Code, are repealed.
14	14	(b) The subchapter heading to Subchapter C, Chapter 2108,
15	15	Government Code, is repealed.
16	16	SECTION 3. CONFORMING AMENDMENT. Section 2113.107(f),
17	17	Government Code, is amended to read as follows:
18	18	(f) Subsection (e) does not apply to the publication of a
19	19	brochure regarding approved foods under the federal special
20	20	supplemental food program for women, infants, and children
21	21	administered by the Texas Department of Health, a publication
22	22	designed to promote tourism or economic development, a publication
23	23	of the Texas School for the Deaf or the Texas School for the Blind
24	24	and Visually Impaired, [a publication of the Texas Incentive and
25	25	Productivity Commission,] or a publication of an institution of
26	26	higher education.
27	27	SECTION 4. CONFORMING REPEALERS. The following laws are
28	28	repealed:

69	69	SECTION 5. ABOLITION. On the effective date of this Act:
70	70	(1) the Texas Incentive and Productivity Commission is
71	71	abolished;
72	72	(2) all commission employee positions are eliminated;
73	73	(3) the state employee incentive program under
74	74	Subchapter B, Chapter 2108, Government Code, is abolished; and
75	75	(4) any memorandum of understanding or interagency
76	76	contract entered into between the Texas Incentive and Productivity
77	77	Commission and another state agency expires.
78	78	SECTION 6. EFFECTIVE DATE. This Act takes effect
79	79	immediately if it receives a vote of two-thirds of all the members
80	80	elected to each house, as provided by Section 39, Article III, Texas
81	81	Constitution. If this Act does not receive the vote necessary for
82	82	immediate effect, this Act takes effect September 1, 2009.
