77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. AMENDMENT. The heading to Chapter 2108,
99 Government Code, is amended to read as follows:
1010 CHAPTER 2108. SAVINGS [EMPLOYEE] INCENTIVE PROGRAM FOR STATE [AND]
1111 AGENCY [PRODUCTIVITY]
1212 SECTION 2. REPEALER. (a) Subchapters A and B, Chapter
1313 2108, Government Code, are repealed.
1414 (b) The subchapter heading to Subchapter C, Chapter 2108,
1515 Government Code, is repealed.
1616 SECTION 3. CONFORMING AMENDMENT. Section 2113.107(f),
1717 Government Code, is amended to read as follows:
1818 (f) Subsection (e) does not apply to the publication of a
1919 brochure regarding approved foods under the federal special
2020 supplemental food program for women, infants, and children
2121 administered by the Texas Department of Health, a publication
2222 designed to promote tourism or economic development, a publication
2323 of the Texas School for the Deaf or the Texas School for the Blind
2424 and Visually Impaired, [a publication of the Texas Incentive and
2525 Productivity Commission,] or a publication of an institution of
2626 higher education.

6969 SECTION 5. ABOLITION. On the effective date of this Act:
7070 (1) the Texas Incentive and Productivity Commission is
7171 abolished;
7272 (2) all commission employee positions are eliminated;
7373 (3) the state employee incentive program under
7474 Subchapter B, Chapter 2108, Government Code, is abolished; and
7575 (4) any memorandum of understanding or interagency
7676 contract entered into between the Texas Incentive and Productivity
7777 Commission and another state agency expires.
7878 SECTION 6. EFFECTIVE DATE. This Act takes effect
7979 immediately if it receives a vote of two-thirds of all the members
8080 elected to each house, as provided by Section 39, Article III, Texas
8181 Constitution. If this Act does not receive the vote necessary for
8282 immediate effect, this Act takes effect September 1, 2009.
