9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter E, Chapter 203, Transportation Code, | |
11 | 11 | is amended by adding Section 203.096 to read as follows: | |
12 | 12 | Sec. 203.096. SUBSURFACE ACCESS IN RIGHT-OF-WAY. (a) The | |
13 | 13 | commission shall allow subsurface access to a controlled access | |
14 | 14 | highway right-of-way for the installation of a natural gas pipeline | |
15 | 15 | that does not interfere with existing utilities located in the | |
16 | 16 | right-of-way. The commission may regulate the horizontal or | |
17 | 17 | vertical location of the pipeline within the right-of-way. | |
18 | 18 | (b) The commission may require a natural gas pipeline | |
19 | 19 | operator to relocate facilities at the cost of the operator to | |
20 | 20 | accommodate construction or expansion of the highway or for any | |
21 | 21 | other public work. | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2009. |
