9 | 9 | relating to an exemption from the food stamp employment and | |
10 | 10 | training program requirement for certain persons. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Chapter 33, Human Resources Code, is amended by | |
13 | 13 | adding Section 33.0126 to read as follows: | |
14 | 14 | Sec. 33.0126. EXEMPTION FROM FOOD STAMP EMPLOYMENT AND | |
15 | 15 | TRAINING PROGRAM. A person is not required to participate in the | |
16 | 16 | food stamp employment and training program authorized under 7 | |
17 | 17 | U.S.C. Section 2015(d) if the person: | |
18 | 18 | (1) works an average of at least 20 hours each week; or | |
19 | 19 | (2) receives earnings that are equal to at least the | |
20 | 20 | minimum wage established under Section 62.051, Labor Code, | |
21 | 21 | multiplied by 20. | |
22 | 22 | SECTION 2. If before implementing any provision of this Act | |
23 | 23 | a state agency determines that a waiver or authorization from a | |
24 | 24 | federal agency is necessary for implementation of that provision, | |
25 | 25 | the agency affected by the provision shall request the waiver or | |
26 | 26 | authorization and may delay implementing that provision until the | |
27 | 27 | waiver or authorization is granted. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2009. |
