99 relating to an exemption from the food stamp employment and
1010 training program requirement for certain persons.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 33, Human Resources Code, is amended by
1313 adding Section 33.0126 to read as follows:
1414 Sec. 33.0126. EXEMPTION FROM FOOD STAMP EMPLOYMENT AND
1515 TRAINING PROGRAM. A person is not required to participate in the
1616 food stamp employment and training program authorized under 7
1717 U.S.C. Section 2015(d) if the person:
1818 (1) works an average of at least 20 hours each week; or
1919 (2) receives earnings that are equal to at least the
2020 minimum wage established under Section 62.051, Labor Code,
2121 multiplied by 20.
2222 SECTION 2. If before implementing any provision of this Act
2323 a state agency determines that a waiver or authorization from a
2424 federal agency is necessary for implementation of that provision,
2525 the agency affected by the provision shall request the waiver or
2626 authorization and may delay implementing that provision until the
2727 waiver or authorization is granted.
2828 SECTION 3. This Act takes effect September 1, 2009.
