99 relating to the Women's Health Program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1212 amended by adding Section 531.095 to read as follows:
1313 Sec. 531.095. IMPLEMENTATION OF MEASURES TO ACHIEVE
1414 CASELOAD AND COST-SAVINGS ESTIMATES. (a) To attain the state and
1515 federal cost-savings and reduced rates of unintended pregnancies
1616 estimated in the waiver application, or any renewal waiver
1717 application, submitted to the Centers for Medicare and Medicaid
1818 Services for implementation of the demonstration project
1919 authorized under Section 32.0248, Human Resources Code, the
2020 commission shall implement effective education, outreach, and
2121 other measures designed to increase participation in the
2222 demonstration project and through the increased participation
2323 achieve the caseload and cost-saving estimates stated in the waiver
2424 application.
2525 (b) The commission, in complying with Subsection (a), may
2626 not take any action to decrease the level of programs and services
2727 designed to reduce the number of unintended pregnancies and lower
2828 the rates of sexually transmitted diseases to below the level of
2929 programs and services provided on September 1, 2009.
3030 SECTION 2. Section 32.0248, Human Resources Code, is
3131 amended by adding Subsections (b-1), (b-2), and (b-3) to read as
3232 follows:
3333 (b-1) The department shall identify women potentially
3434 eligible for participation in the demonstration project following
3535 pregnancies for which the women received benefits through the
3636 medical assistance program and assist those women in establishing
3737 eligibility for the demonstration project. Benefits received
3838 through the demonstration project shall begin on the first day of
3939 the month following termination of eligibility for the medical
4040 assistance program.
4141 (b-2) The department shall modify any applicable
4242 administrative procedures to ensure that a woman described by
4343 Subsection (b-1) maintains continuous eligibility for any services
4444 provided by both the medical assistance program and the
4545 demonstration project during the transition from participation in
4646 the medical assistance program to participation in the
4747 demonstration project.
4848 (b-3) The department shall require any entity that provides
4949 information and services to participants in the medical assistance
5050 program to provide the following information to women who are
5151 potentially eligible for the demonstration project:
5252 (1) a description of benefits available through the
5353 demonstration project; and
5454 (2) information on how to apply for enrollment in the
5555 demonstration project.
5656 SECTION 3. If before implementing any provision of this Act
5757 a state agency determines that a waiver or authorization from a
5858 federal agency is necessary for implementation of that provision,
5959 the agency affected by the provision shall request the waiver or
6060 authorization in a timely manner and may delay implementing that
6161 provision until the waiver or authorization is granted.
6262 SECTION 4. This Act takes effect September 1, 2009.
