| 8 | 8 | | extracurricular activities or competitions after transferring or |

| 9 | 9 | | moving from one public school to another. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 33, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 33.088 to read as follows: |
|---|
| 13 | 13 | | Sec. 33.088. ELIGIBILITY OF CERTAIN TRANSFER STUDENTS. A |
|---|
| 14 | 14 | | student who transfers to a school or moves into the attendance zone |
|---|
| 15 | 15 | | of a school for the purpose of participating in an extracurricular |
|---|
| 16 | 16 | | activity or a University Interscholastic League competition |
|---|
| 17 | 17 | | offered at that school is not ineligible to participate in the |
|---|
| 18 | 18 | | activity or competition if: |
|---|
| 19 | 19 | | (1) the activity or competition is not offered at the |
|---|
| 20 | 20 | | school from which the student transferred or moved; and |
|---|
| 21 | 21 | | (2) the student is otherwise eligible to participate |
|---|
| 22 | 22 | | in the activity or competition. |
|---|
| 23 | 23 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 24 | 24 | | school year. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
