| 11 | 11 | SECTION 1. Subchapter A, Chapter 37, Education Code, is | |
| 12 | 12 | amended by adding Section 37.023 to read as follows: | |
| 13 | 13 | Sec. 37.023. LIMITATION ON REFERRAL TO LAW ENFORCEMENT | |
| 14 | 14 | OFFICIAL FOR VIOLATION OF STUDENT CODE OF CONDUCT. A school | |
| 15 | 15 | administrator may not refer a student to a law enforcement official | |
| 16 | 16 | on the basis of conduct by the student that violates the school | |
| 17 | 17 | district's student code of conduct but that the administrator knows | |
| 18 | 18 | or has reason to know is not a criminal offense. | |
| 19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2009. |
