66 AN ACT
77 relating to referral of public school students to law enforcement
88 officials for violations of an independent school district student
99 code of conduct.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 37, Education Code, is
1212 amended by adding Section 37.023 to read as follows:
1313 Sec. 37.023. LIMITATION ON REFERRAL TO LAW ENFORCEMENT
1414 OFFICIAL FOR VIOLATION OF STUDENT CODE OF CONDUCT. A school
1515 administrator may not refer a student to a law enforcement official
1616 on the basis of conduct by the student that violates the school
1717 district's student code of conduct but that the administrator knows
1818 or has reason to know is not a criminal offense.
1919 SECTION 2. This Act takes effect immediately if it receives
2020 a vote of two-thirds of all the members elected to each house, as
2121 provided by Section 39, Article III, Texas Constitution. If this
2222 Act does not receive the vote necessary for immediate effect, this
2323 Act takes effect September 1, 2009.
