| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 22, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 22.008 to read as follows: |
|---|
| 12 | 12 | | Sec. 22.008. TERMINATION OR SUSPENSION OF EDUCATIONAL |
|---|
| 13 | 13 | | SUPPORT EMPLOYEES. (a) In this section, "educational support |
|---|
| 14 | 14 | | employee" means an employee of a school district who is not entitled |
|---|
| 15 | 15 | | under Section 21.002 to be employed under a contract. |
|---|
| 16 | 16 | | (b) A person who proposes to terminate the employment of or |
|---|
| 17 | 17 | | suspend without pay an educational support employee must submit to |
|---|
| 18 | 18 | | the superintendent written notice of the proposed action. The |
|---|
| 19 | 19 | | notice must include a statement of the reasons for the proposed |
|---|
| 20 | 20 | | action. |
|---|
| 21 | 21 | | (c) On receipt of notice under Subsection (b), the |
|---|
| 22 | 22 | | superintendent shall reject or approve the proposed action. If the |
|---|
| 23 | 23 | | superintendent approves the proposed action, the superintendent or |
|---|
| 24 | 24 | | the person proposing the action must present the employee with a |
|---|
| 25 | 25 | | written copy of the notice. |
|---|
| 26 | 26 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 27 | 27 | | school year. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2009. |
