66 AN ACT
77 relating to termination or suspension without pay of certain public
88 school district employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 22, Education Code, is
1111 amended by adding Section 22.008 to read as follows:
1212 Sec. 22.008. TERMINATION OR SUSPENSION OF EDUCATIONAL
1313 SUPPORT EMPLOYEES. (a) In this section, "educational support
1414 employee" means an employee of a school district who is not entitled
1515 under Section 21.002 to be employed under a contract.
1616 (b) A person who proposes to terminate the employment of or
1717 suspend without pay an educational support employee must submit to
1818 the superintendent written notice of the proposed action. The
1919 notice must include a statement of the reasons for the proposed
2020 action.
2121 (c) On receipt of notice under Subsection (b), the
2222 superintendent shall reject or approve the proposed action. If the
2323 superintendent approves the proposed action, the superintendent or
2424 the person proposing the action must present the employee with a
2525 written copy of the notice.
2626 SECTION 2. This Act applies beginning with the 2009-2010
2727 school year.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2009.
