66 AN ACT
77 relating to reports to the legislature on certain administrative
88 hearings regarding the automatic suspension of a person's driver's
99 license.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 524, Transportation Code,
1212 is amended by adding Section 524.045 to read as follows:
1313 Sec. 524.045. QUARTERLY REPORTS TO LEGISLATURE. (a) Not
1414 later than the 30th day following the end of each calendar quarter,
1515 the State Office of Administrative Hearings shall submit a report
1616 to the legislature indicating for each county the total number of
1717 administrative hearings decided under this chapter during the
1818 previous calendar quarter and, of those hearings:
1919 (1) the percentage in which the administrative law
2020 judge decided in favor of the person who requested the hearing; and
2121 (2) the percentage in which the administrative law
2222 judge decided in favor of the department.
2323 (b) Not later than the 30th day following the end of each
2424 calendar quarter, the department shall submit a report to the
2525 legislature indicating for each county the total number of appeals
2626 from administrative hearings held under this chapter that were
2727 decided during the previous calendar quarter and, of those appeals:
2828 (1) the percentage in which the court decided in favor
2929 of the person whose license was suspended; and
3030 (2) the percentage in which the court decided in favor
3131 of the department.
3232 SECTION 2. The State Office of Administrative Hearings and
3333 the Department of Public Safety shall submit the initial reports
3434 required by Section 524.045, Transportation Code, as added by this
3535 Act, not later than January 30, 2010, based on data from the
3636 previous calendar quarter.
3737 SECTION 3. This Act takes effect September 1, 2009.
