55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain personal information contained in a decree of
88 dissolution of a marriage or an order in a suit affecting the
99 parent-child relationship.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter H, Chapter 6, Family Code, is amended
1212 by adding Section 6.712 to read as follows:
1313 Sec. 6.712. PERSONAL INFORMATION IN DECREE. (a) In this
1414 section, "personal information" means:
1515 (1) an individual's social security number;
1616 (2) an individual's bank account number and similar
1717 financial information; and
1818 (3) the name and birth date of each child of an
1919 individual.
2020 (b) A final decree of dissolution of a marriage, and any
2121 modification of the decree, may not contain personal information
2222 with regard to any party to the decree. Any personal information
2323 that is required by this title or any other law to be in the decree
2424 or modification must be listed in a separate document titled
2525 "CONFIDENTIAL DATA PAGE" in bold type.
2626 (c) The separate document described by Subsection (b) must
2727 include the cause number and style of the proceeding.
2828 (d) The personal information in the separate document
2929 described by Subsection (b) is confidential and may be disclosed
3030 only to:
3131 (1) a party to the proceeding or an attorney for a
3232 party to the proceeding;
3333 (2) a law enforcement agency, the Title IV-D agency,
3434 or another governmental entity conducting a criminal investigation
3535 or establishing or enforcing a child support order; or
3636 (3) another person authorized to obtain the
3737 information by a court order that includes a finding of good cause
3838 for disclosing the information to that person.
3939 (e) This section does not require a court to grant access to
4040 confidential personal information if access is restricted by other
4141 law.
4242 SECTION 2. Section 105.006(a), Family Code, is amended to
4343 read as follows:
4444 (a) A final order, other than in a proceeding under Chapter
4545 161 or 162, must contain:
4646 (1) the [social security number and] driver's license
4747 number of each party to the suit, including the child, except that
4848 the child's [social security number or] driver's license number is
4949 not required if the child has not been assigned a [social security
5050 number or] driver's license number; and
5151 (2) each party's current residence address, mailing
5252 address, home telephone number, name of employer, address of
5353 employment, and work telephone number, except as provided by
5454 Subsection (c).
5555 SECTION 3. Chapter 105, Family Code, is amended by adding
5656 Section 105.010 to read as follows:
5757 Sec. 105.010. PERSONAL INFORMATION IN CERTAIN ORDERS. (a)
5858 In this section, "personal information" means:
5959 (1) an individual's social security number;
6060 (2) an individual's bank account number and similar
6161 financial information; and
6262 (3) the name and birth date of each child of an
6363 individual.
6464 (b) An order in a suit affecting the parent-child
6565 relationship may not contain personal information with regard to
6666 any party to the suit. Any personal information that is required by
6767 this title or any other law to be in the order must be listed in a
6868 separate document titled "CONFIDENTIAL DATA PAGE" in bold type.
6969 (c) The separate document described by Subsection (b) must
7070 include the cause number and style of the proceeding.
7171 (d) The personal information in the separate document
7272 described by Subsection (b) is confidential and may be disclosed
7373 only to:
7474 (1) a party to the suit or an attorney for a party to
7575 the suit;
7676 (2) a law enforcement agency, the Title IV-D agency,
7777 or another governmental entity conducting a criminal investigation
7878 or enforcing a child support order; or
7979 (3) another person authorized to obtain the
8080 information by a court order that includes a finding of good cause
8181 for disclosing the information to that person.
8282 (e) This section does not require a court to grant access to
8383 confidential personal information if access is restricted by other
8484 law.
8585 SECTION 4. The changes in law made by this Act apply only to
8686 a decree of dissolution of a marriage or order in a suit affecting
8787 the parent-child relationship that is rendered or issued on or
8888 after the effective date of this Act. A decree or order rendered or
8989 issued before the effective date of this Act is governed by the law
9090 in effect on the date the decree or order was rendered or issued,
9191 and the former law is continued in effect for that purpose.
9292 SECTION 5. This Act takes effect September 1, 2009.
