55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to evaluation under the public school accountability
88 system of the delivery of library resources.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.072, Education Code, is amended by
1111 adding Subsection (b-1) and amending Subsection (c) to read as
1212 follows:
1313 (b-1) Additional criteria in the rules for rating a school
1414 district under this section must include consideration of the
1515 effectiveness of the district's delivery of resources from school
1616 libraries.
1717 (c) The agency shall evaluate against state standards and
1818 shall, not later than August 1 of each year, report the performance
1919 of each campus in a district and each open-enrollment charter
2020 school on the basis of the campus's performance on the indicators
2121 adopted under Sections 39.051(b)(1) through (8). Consideration of
2222 the effectiveness of district programs under Subsection (b)(2) or
2323 (3) must be based on data collected through the Public Education
2424 Information Management System for purposes of accountability under
2525 this chapter and include the results of assessments required under
2626 Section 39.023. Consideration of the effectiveness of district
2727 delivery of library resources under Subsection (b-1) must be based
2828 on whether a library is located on each campus and whether a
2929 librarian is employed by the district to staff a library at each
3030 campus.
3131 SECTION 2. This Act applies beginning with the 2009-2010
3232 school year.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2009.
