55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the receipt of an exemption or waiver for a school
88 district or campus that is academically unacceptable.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 7.056(a), (e), and (f), Education Code,
1111 are amended to read as follows:
1212 (a) Except as provided by Subsection (e) or (f), a school
1313 campus or district may apply to the commissioner for a waiver of a
1414 requirement, restriction, or prohibition imposed by this code or
1515 rule of the board or commissioner.
1616 (e) A [Except as provided by Subsection (f), a] school
1717 campus or district may not receive an exemption or waiver under this
1818 section from:
1919 (1) a prohibition on conduct that constitutes a
2020 criminal offense;
2121 (2) a requirement imposed by federal law or rule,
2222 including a requirement for special education or bilingual
2323 education programs; or
2424 (3) a requirement, restriction, or prohibition
2525 relating to:
2626 (A) essential knowledge or skills under Section
2727 28.002 or minimum graduation requirements under Section 28.025;
2828 (B) public school accountability as provided by
2929 Subchapters B, C, D, and G, Chapter 39;
3030 (C) extracurricular activities under Section
3131 33.081 or participation in a University Interscholastic League
3232 area, regional, or state competition under Section 33.0812;
3333 (D) health and safety under Chapter 38;
3434 (E) purchasing under Subchapter B, Chapter 44;
3535 (F) elementary school class size limits, except
3636 as provided by Section 25.112;
3737 (G) removal of a disruptive student from the
3838 classroom under Subchapter A, Chapter 37;
3939 (H) at-risk programs under Subchapter C, Chapter
4040 29;
4141 (I) prekindergarten programs under Subchapter E,
4242 Chapter 29;
4343 (J) educator rights and benefits under
4444 Subchapters A, C, D, E, F, G, and I, Chapter 21, or under Subchapter
4545 A, Chapter 22;
4646 (K) special education programs under Subchapter
4747 A, Chapter 29;
4848 (L) bilingual education programs under
4949 Subchapter B, Chapter 29; or
5050 (M) the requirements for the first day of
5151 instruction under Section 25.0811.
5252 (f) A school district or campus that is academically
5353 unacceptable as provided by Section 39.072 or 39.132 [is required
5454 to develop and implement a student achievement improvement plan
5555 under Section 39.131 or 39.132] may not receive an exemption or
5656 waiver under this section from any law or rule [other than:
5757 [(1) a prohibition on conduct that constitutes a
5858 criminal offense;
5959 [(2) a requirement imposed by federal law or rule;
6060 [(3) a requirement, restriction, or prohibition
6161 imposed by state law or rule relating to:
6262 [(A) public school accountability as provided by
6363 Subchapters B, C, D, and G, Chapter 39; or
6464 [(B) educator rights and benefits under
6565 Subchapters A, C, D, E, F, G, and I, Chapter 21, or under Subchapter
6666 A, Chapter 22; or
6767 [(4) textbook selection under Chapter 31].
6868 SECTION 2. This Act applies beginning with the 2009-2010
6969 school year.
7070 SECTION 3. This Act takes effect immediately if it receives
7171 a vote of two-thirds of all the members elected to each house, as
7272 provided by Section 39, Article III, Texas Constitution. If this
7373 Act does not receive the vote necessary for immediate effect, this
7474 Act takes effect September 1, 2009.
