9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 498.004(a), Government Code, as amended | |
11 | 11 | by Chapters 249 and 321, Acts of the 74th Legislature, Regular | |
12 | 12 | Session, 1995, is reenacted and amended to read as follows: | |
13 | 13 | (a) If, during the actual term of imprisonment of an inmate | |
14 | 14 | in the department [institutional division] or in a transfer | |
15 | 15 | facility, the inmate commits an offense or violates a rule of the | |
16 | 16 | department [division], the department may forfeit all or any part | |
17 | 17 | of the inmate's accrued good conduct time. The department may [not] | |
18 | 18 | restore good conduct time forfeited under this subsection. | |
19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
23 | 23 | Act takes effect September 1, 2009. |
