77 relating to requiring minority impact statements for state agency
88 grant applications.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 10, Government Code, is
1111 amended by adding Chapter 2060 to read as follows:
1212 CHAPTER 2060. MINORITY IMPACT STATEMENTS FOR STATE AGENCY GRANTS
1313 Sec. 2060.001. DEFINITIONS. In this chapter:
1414 (1) "Disabled individual" means an individual who has
1515 a physical or mental impairment that substantially limits at least
1616 one major life activity, who has a record of the impairment, or who
1717 is regarded as having or having had the impairment.
1818 (2) "Major life activity" includes functions such as
1919 caring for one's self, performing manual tasks, walking, seeing,
2020 hearing, speaking, breathing, learning, or working.
2121 (3) "Minority individual" includes a disabled
2222 individual and an individual who is a woman, African American,
2323 Latino, Asian, Pacific Islander, American Indian, or Alaska Native.
2424 (4) "State agency" means an office, board, commission,
2525 agency, or other entity in the executive, judicial, or legislative
2626 branch of state government.
2727 Sec. 2060.002. MINORITY IMPACT STATEMENT REQUIRED. An
2828 applicant for a grant issued or administered by a state agency shall
2929 include with the grant application a minority impact statement on a
3030 form created under Section 2060.003 that contains:
3131 (1) information about any disproportionate or unique
3232 impact on minority individuals in this state by proposed policies
3333 or programs funded by the grant;
3434 (2) a rationale for the existence of any policies or
3535 programs described by Subdivision (1); and
3636 (3) evidence of consultation with representatives of
3737 minority individuals regarding a policy or program described by
3838 Subdivision (1).
3939 Sec. 2060.003. CREATION AND DISTRIBUTION OF FORM. The
4040 office of the governor shall create the minority impact statement
4141 form, distribute the form to state agencies, and ensure that state
4242 agencies include the form with other grant application forms.
4343 Sec. 2060.004. COORDINATION WITH FEDERAL LAW. This chapter
4444 applies to a grant applicant to the extent consistent with federal
4545 law.
4646 SECTION 2. Chapter 2060, Government Code, as added by this
4747 Act, applies only to a grant application submitted to a state agency
4848 on or after January 1, 2010.
4949 SECTION 3. This Act takes effect September 1, 2009.
