| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle B, Title 10, Government Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 2060 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 2060. MINORITY IMPACT STATEMENTS FOR STATE AGENCY GRANTS |
|---|
| 13 | 13 | | Sec. 2060.001. DEFINITIONS. In this chapter: |
|---|
| 14 | 14 | | (1) "Disabled individual" means an individual who has |
|---|
| 15 | 15 | | a physical or mental impairment that substantially limits at least |
|---|
| 16 | 16 | | one major life activity, who has a record of the impairment, or who |
|---|
| 17 | 17 | | is regarded as having or having had the impairment. |
|---|
| 18 | 18 | | (2) "Major life activity" includes functions such as |
|---|
| 19 | 19 | | caring for one's self, performing manual tasks, walking, seeing, |
|---|
| 20 | 20 | | hearing, speaking, breathing, learning, or working. |
|---|
| 21 | 21 | | (3) "Minority individual" includes a disabled |
|---|
| 22 | 22 | | individual and an individual who is a woman, African American, |
|---|
| 23 | 23 | | Latino, Asian, Pacific Islander, American Indian, or Alaska Native. |
|---|
| 24 | 24 | | (4) "State agency" means an office, board, commission, |
|---|
| 25 | 25 | | agency, or other entity in the executive, judicial, or legislative |
|---|
| 26 | 26 | | branch of state government. |
|---|
| 27 | 27 | | Sec. 2060.002. MINORITY IMPACT STATEMENT REQUIRED. An |
|---|
| 28 | 28 | | applicant for a grant issued or administered by a state agency shall |
|---|
| 29 | 29 | | include with the grant application a minority impact statement on a |
|---|
| 30 | 30 | | form created under Section 2060.003 that contains: |
|---|
| 31 | 31 | | (1) information about any disproportionate or unique |
|---|
| 32 | 32 | | impact on minority individuals in this state by proposed policies |
|---|
| 33 | 33 | | or programs funded by the grant; |
|---|
| 34 | 34 | | (2) a rationale for the existence of any policies or |
|---|
| 35 | 35 | | programs described by Subdivision (1); and |
|---|
| 36 | 36 | | (3) evidence of consultation with representatives of |
|---|
| 37 | 37 | | minority individuals regarding a policy or program described by |
|---|
| 38 | 38 | | Subdivision (1). |
|---|
| 39 | 39 | | Sec. 2060.003. CREATION AND DISTRIBUTION OF FORM. The |
|---|
| 40 | 40 | | office of the governor shall create the minority impact statement |
|---|
| 41 | 41 | | form, distribute the form to state agencies, and ensure that state |
|---|
| 42 | 42 | | agencies include the form with other grant application forms. |
|---|
| 43 | 43 | | Sec. 2060.004. COORDINATION WITH FEDERAL LAW. This chapter |
|---|
| 44 | 44 | | applies to a grant applicant to the extent consistent with federal |
|---|
| 45 | 45 | | law. |
|---|
| 46 | 46 | | SECTION 2. Chapter 2060, Government Code, as added by this |
|---|
| 47 | 47 | | Act, applies only to a grant application submitted to a state agency |
|---|
| 48 | 48 | | on or after January 1, 2010. |
|---|
| 49 | 49 | | SECTION 3. This Act takes effect September 1, 2009. |
