8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter H, Chapter 6, Family Code, is amended |
---|
10 | 10 | | by adding Section 6.7021 to read as follows: |

11 | 11 | | Sec. 6.7021. AGREED ORDER. An agreed order in a suit for |
---|
12 | 12 | | dissolution of a marriage must comply with Section 105.0061. |
---|
13 | 13 | | SECTION 2. Section 85.005, Family Code, is amended by |
---|
14 | 14 | | adding Subsection (f) to read as follows: |
---|
15 | 15 | | (f) An agreed protective order must comply with Section |
---|
16 | 16 | | 105.0061. |
---|
17 | 17 | | SECTION 3. Chapter 105, Family Code, is amended by adding |
---|
18 | 18 | | Section 105.0061 to read as follows: |

19 | 19 | | Sec. 105.0061. AGREED ORDER. An agreed order in a suit |
---|
20 | 20 | | affecting the parent-child relationship or other suit under this |
---|
21 | 21 | | code, other than Title 3, is not valid unless the order is signed by |
---|
22 | 22 | | each party to the suit and each attorney representing a party to the |
---|
23 | 23 | | suit. Each party and party's attorney must sign the order before |
---|
24 | 24 | | the order is signed by the judge or entered into the record. |
---|
25 | 25 | | SECTION 4. The changes in law made by this Act apply only to |
---|
26 | 26 | | an agreed order entered into on or after the effective date of this |
---|
27 | 27 | | Act. An agreed order entered into before the effective date of this |
---|
28 | 28 | | Act is governed by the law in effect on the date on which the order |
---|
29 | 29 | | was entered into, and the former law is continued in effect for that |
---|
30 | 30 | | purpose. |
---|
31 | 31 | | SECTION 5. This Act takes effect September 1, 2009. |
