66 AN ACT
77 relating to agreed orders in family law matters.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter H, Chapter 6, Family Code, is amended
1010 by adding Section 6.7021 to read as follows:
1111 Sec. 6.7021. AGREED ORDER. An agreed order in a suit for
1212 dissolution of a marriage must comply with Section 105.0061.
1313 SECTION 2. Section 85.005, Family Code, is amended by
1414 adding Subsection (f) to read as follows:
1515 (f) An agreed protective order must comply with Section
1616 105.0061.
1717 SECTION 3. Chapter 105, Family Code, is amended by adding
1818 Section 105.0061 to read as follows:
1919 Sec. 105.0061. AGREED ORDER. An agreed order in a suit
2020 affecting the parent-child relationship or other suit under this
2121 code, other than Title 3, is not valid unless the order is signed by
2222 each party to the suit and each attorney representing a party to the
2323 suit. Each party and party's attorney must sign the order before
2424 the order is signed by the judge or entered into the record.
2525 SECTION 4. The changes in law made by this Act apply only to
2626 an agreed order entered into on or after the effective date of this
2727 Act. An agreed order entered into before the effective date of this
2828 Act is governed by the law in effect on the date on which the order
2929 was entered into, and the former law is continued in effect for that
3030 purpose.
3131 SECTION 5. This Act takes effect September 1, 2009.
