| 11 | 11 | SECTION 1. Section 20(b), Article 42.12, Code of Criminal | |
| 12 | 12 | Procedure, is amended to read as follows: | |
| 13 | 13 | (b) This section does not apply to: | |
| 14 | 14 | (1) a defendant convicted of an offense [under | |
| 15 | 15 | Sections 49.04-49.08, Penal Code, a defendant convicted of an | |
| 16 | 16 | offense] for which on conviction registration as a sex offender is | |
| 17 | 17 | required under Chapter 62; [,] or | |
| 18 | 18 | (2) a defendant convicted of a felony described by | |
| 19 | 19 | Section 3g. | |
| 20 | 20 | SECTION 2. The change in law made by this Act applies to a | |
| 21 | 21 | defendant who is placed on community supervision before, on, or | |
| 22 | 22 | after the effective date of this Act. | |
| 23 | 23 | SECTION 3. This Act takes effect September 1, 2009. |
