66 AN ACT
77 relating to duty-free lunch periods for public school nurses.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 21.405(a) and (c), Education Code, are
1010 amended to read as follows:
1111 (a) Except as provided by Subsection (c), each classroom
1212 teacher, full-time school nurse, or full-time librarian is entitled
1313 to at least a 30-minute lunch period free from all duties and
1414 responsibilities connected with the instruction and supervision of
1515 students. Each school district may set flexible or rotating
1616 schedules for each classroom teacher, full-time school nurse, or
1717 full-time librarian in the district for the implementation of the
1818 duty-free lunch period.
1919 (c) If necessary because of a personnel shortage, extreme
2020 economic conditions, or an unavoidable or unforeseen circumstance,
2121 a school district may require a classroom teacher, nurse, or
2222 librarian entitled to a duty-free lunch to supervise students
2323 during lunch. A classroom teacher, nurse, or librarian may not be
2424 required to supervise students under this subsection more than one
2525 day in any school week. The commissioner by rule shall prescribe
2626 guidelines for determining what constitutes a personnel shortage,
2727 extreme economic conditions, or an unavoidable or unforeseen
2828 circumstance for purposes of this subsection.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
