66 AN ACT
77 relating to restrictions on the disclosure of certain criminal
88 history records and to the duty of law enforcement agencies
99 regarding records associated with certain defendants; creating an
1010 offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 411.081(d), Government Code, is amended
1313 to read as follows:
1414 (d) Notwithstanding any other provision of this subchapter,
1515 if a person is placed on community supervision, including deferred
1616 adjudication community supervision, under [Section 5,] Article
1717 42.12, Code of Criminal Procedure, successfully completes the
1818 period of community supervision or [subsequently] receives a
1919 discharge and dismissal under Section 5(c), Article 42.12, Code of
2020 Criminal Procedure, as applicable, and satisfies the requirements
2121 of Subsection (e), the person may petition the court that placed the
2222 person [defendant] on community supervision [deferred
2323 adjudication] for an order of nondisclosure under this subsection.
2424 Except as provided by Subsection (e), a person may petition the
2525 court under this subsection regardless of whether the person has
2626 been previously placed on [deferred adjudication] community
2727 supervision for another offense. After notice to the state and a
2828 hearing on whether the person is entitled to file the petition and
2929 issuance of the order is in the best interest of justice, the court
3030 shall issue an order prohibiting criminal justice agencies from
3131 disclosing to the public criminal history record information
3232 related to the offense giving rise to the community supervision
3333 [deferred adjudication]. A criminal justice agency may disclose
3434 criminal history record information that is the subject of the
3535 order only to other criminal justice agencies, for criminal justice
3636 or regulatory licensing purposes, an agency or entity listed in
3737 Subsection (i), or the person who is the subject of the order. A
3838 person may petition the court [that placed the person on deferred
3939 adjudication] for an order of nondisclosure on payment of a $28 fee
4040 to the clerk of the court in addition to any other fee that
4141 generally applies to the filing of a civil petition. The payment
4242 may be made only on or after:
4343 (1) the date on which the period of community
4444 supervision expires or, for a person who was placed on deferred
4545 adjudication community supervision, the date on which the
4646 proceedings are dismissed and the person is discharged under
4747 Section 5(c), Article 42.12 [the discharge and dismissal], if the
4848 offense for which the person was placed on community supervision
4949 [deferred adjudication] was a misdemeanor other than a misdemeanor
5050 described by Subdivision (2);
5151 (2) the second anniversary of the date described by
5252 Subdivision (1) [discharge and dismissal], if the offense for which
5353 the person was placed on community supervision [deferred
5454 adjudication] was a misdemeanor under Chapter 20, 21, 22, 25, 42, or
5555 46, Penal Code; or
5656 (3) the fifth anniversary of the date described by
5757 Subdivision (1) [discharge and dismissal], if the offense for which
5858 the person was placed on community supervision [deferred
5959 adjudication] was a felony.
6060 SECTION 2. The heading to Section 552.142, Government Code,
6161 is amended to read as follows:
6262 Sec. 552.142. EXCEPTION: [RECORDS OF] CERTAIN CRIMINAL
6363 HISTORY RECORDS [DEFERRED ADJUDICATIONS].
6464 SECTION 3. Chapter 39, Penal Code, is amended by adding
6565 Section 39.07 to read as follows:
6666 Sec. 39.07. PROHIBITED COMPILATION OR DISSEMINATION OF
6767 CRIMINAL HISTORY RECORD INFORMATION. (a) A person commits an
6868 offense if, with intent to obtain a benefit or with intent to harm
6969 or defraud another, the person compiles or disseminates criminal
7070 history record information that the person knows is the subject of
7171 an order of nondisclosure issued under Section 411.081, Government
7272 Code.
7373 (b) An offense under this section is a Class A misdemeanor.
7474 (c) It is a defense to prosecution under this section that
7575 the person compiled or disseminated the information for a purpose
7676 described by Section 411.083(a) or (b)(1), (2), or (3), Government
7777 Code, or another purpose specifically authorized by law.
7878 SECTION 4. The change in law made by this Act to Section
7979 411.081(d), Government Code, applies to criminal history record
8080 information related to the placement of a person on community
8181 supervision regardless of whether the community supervision was
8282 ordered before, on, or after the effective date of this Act.
8383 SECTION 5. This Act takes effect September 1, 2009.
