99 relating to the eligibility of certain public officers to the
1010 legislature and prohibiting legislators from other public
1111 employment.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle A, Title 3, Government Code, is amended
1414 by adding Chapter 307 to read as follows:
1515 CHAPTER 307. ELIGIBILITY TO LEGISLATURE
1616 Sec. 307.001. INELIGIBILITY OF PERSONS HOLDING OTHER
1717 OFFICES. (a) A judge of any court, the secretary of state, the
1818 attorney general, the clerk of any court of record, or any other
1919 person holding a lucrative office under the United States, this
2020 state, including a political subdivision of this state, or any
2121 foreign government is ineligible to serve in the legislature during
2222 the term for which the person is elected or appointed.
2323 (b) The ineligibility provided by Subsection (a) applies to
2424 the entire term to which the officeholder was elected or appointed
2525 and is not affected by the officeholder's resignation or removal
2626 from office before the end of the term.
2727 (c) For purposes of Subsection (a), an office is lucrative
2828 if the officeholder is entitled to receive any salary, fee, or other
2929 compensation, no matter how small.
3030 (d) A person who is ineligible to serve in the legislature
3131 under this section may not file an application for a place on the
3232 ballot as a candidate for the legislature for a legislative term
3333 during which the ineligibility applies for any portion of the term.
3434 An application filed in violation of this subsection is invalid.
3535 (e) For purposes of this section, "office" does not include:
3636 (1) a notary public; or
3737 (2) a position in:
3838 (A) the armed forces reserve of the United
3939 States; or
4040 (B) the state military forces, other than a
4141 position described by Section 431.003(a).
4242 Sec. 307.002. PROHIBITION ON PUBLIC EMPLOYMENT BY
4343 LEGISLATOR. A member of the legislature may not, during the term
4444 for which the member is elected, be simultaneously employed in any
4545 position under the United States, this state, including a political
4646 subdivision of this state, or any foreign government.
4747 SECTION 2. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2009.
