55 relating to providing municipalities and counties access to
66 criminal history record information for sexually oriented business

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 411.122, Government Code, is amended by
1010 adding Subsection (b) to read as follows:
1111 (b) A municipality or county that requires a sexually
1212 oriented business to obtain a license or other permit under Section
1313 243.007, Local Government Code, is entitled to obtain from the
1414 department criminal history record information maintained by the
1515 department that relates to a person who:
1616 (1) is an applicant for a license or other permit for a
1717 sexually oriented business issued by the municipality or county;
1818 (2) is the holder of a license or other permit for a
1919 sexually oriented business issued by the municipality or county; or
2020 (3) requests a determination of eligibility for a
2121 license or other permit for a sexually oriented business issued by
2222 the municipality or county.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2009.
