| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 411.122, Government Code, is amended by |
|---|
| 10 | 10 | | adding Subsection (b) to read as follows: |
|---|
| 11 | 11 | | (b) A municipality or county that requires a sexually |
|---|
| 12 | 12 | | oriented business to obtain a license or other permit under Section |
|---|
| 13 | 13 | | 243.007, Local Government Code, is entitled to obtain from the |
|---|
| 14 | 14 | | department criminal history record information maintained by the |
|---|
| 15 | 15 | | department that relates to a person who: |
|---|
| 16 | 16 | | (1) is an applicant for a license or other permit for a |
|---|
| 17 | 17 | | sexually oriented business issued by the municipality or county; |
|---|
| 18 | 18 | | (2) is the holder of a license or other permit for a |
|---|
| 19 | 19 | | sexually oriented business issued by the municipality or county; or |
|---|
| 20 | 20 | | (3) requests a determination of eligibility for a |
|---|
| 21 | 21 | | license or other permit for a sexually oriented business issued by |
|---|
| 22 | 22 | | the municipality or county. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2009. |
