5	5	relating to the purchase of library goods and services by public
6	6	junior colleges.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 44.0311, Education Code, is amended by
9	9	amending Subsection (a) and adding Subsection (c) to read as
10	10	follows:
11	11	(a) Except as provided by Subsection (c), this [This]
12	12	subchapter applies to junior college districts.
13	13	(c) This subchapter does not apply to a purchase,
14	14	acquisition, or license of library goods and services for a library
15	15	operated as a part of a junior college district. In this
16	16	subsection, "library goods and services" has the meaning assigned
17	17	by Section 130.0101(a).
18	18	SECTION 2. Section 130.0101, Education Code, is amended to
19	19	read as follows:
20	20	Sec. 130.0101. ACQUISITION OF LIBRARY MATERIALS. (a) In
21	21	this section, "library goods and services" means:
22	22	(1) serial and journal subscriptions, including
23	23	electronic databases, digital content, and information products;
24	24	(2) other library materials and resources, including
25	25	books, e-books, and media not available under a statewide contract
26	26	and papers;
27	27	(3) library services, including periodical jobber and
28	28	binding services not available under a statewide contract; [and]
29	29	(4) [library] equipment and supplies specific to the
30	30	storage and access of library content; and
31	31	(5) library or resource-sharing programs operated by
32	32	the Texas State Library and Archives Commission.
33	33	(b) Notwithstanding any other law governing purchasing by a
34	34	junior college district, including Section 130.010 or Subchapter B,
35	35	Chapter 44, a junior college district may purchase, license, or
36	36	otherwise acquire library goods and services in any manner
37	37	authorized by law for the purchase, license, or acquisition of
38	38	library goods and services by a public senior college or
39	39	university, as defined by Section 61.003.
40	40	SECTION 3. This Act takes effect immediately if it receives
41	41	a vote of two-thirds of all the members elected to each house, as
42	42	provided by Section 39, Article III, Texas Constitution. If this
43	43	Act does not receive the vote necessary for immediate effect, this
44	44	Act takes effect September 1, 2009.
