44 AN ACT
55 relating to the purchase of library goods and services by public
66 junior colleges.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 44.0311, Education Code, is amended by
99 amending Subsection (a) and adding Subsection (c) to read as
1010 follows:
1111 (a) Except as provided by Subsection (c), this [This]
1212 subchapter applies to junior college districts.
1313 (c) This subchapter does not apply to a purchase,
1414 acquisition, or license of library goods and services for a library
1515 operated as a part of a junior college district. In this
1616 subsection, "library goods and services" has the meaning assigned
1717 by Section 130.0101(a).
1818 SECTION 2. Section 130.0101, Education Code, is amended to
1919 read as follows:
2020 Sec. 130.0101. ACQUISITION OF LIBRARY MATERIALS. (a) In
2121 this section, "library goods and services" means:
2222 (1) serial and journal subscriptions, including
2323 electronic databases, digital content, and information products;
2424 (2) other library materials and resources, including
2525 books, e-books, and media not available under a statewide contract
2626 and papers;
2727 (3) library services, including periodical jobber and
2828 binding services not available under a statewide contract; [and]
2929 (4) [library] equipment and supplies specific to the
3030 storage and access of library content; and
3131 (5) library or resource-sharing programs operated by
3232 the Texas State Library and Archives Commission.
3333 (b) Notwithstanding any other law governing purchasing by a
3434 junior college district, including Section 130.010 or Subchapter B,
3535 Chapter 44, a junior college district may purchase, license, or
3636 otherwise acquire library goods and services in any manner
3737 authorized by law for the purchase, license, or acquisition of
3838 library goods and services by a public senior college or
3939 university, as defined by Section 61.003.
4040 SECTION 3. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2009.
