| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 541.201(24), Transportation Code, is | |
| 12 | 12 | amended to read as follows: | |
| 13 | 13 | (24) "Electric bicycle" means a bicycle that: | |
| 14 | 14 | (A) is designed to be propelled by an electric | |
| 15 | 15 | motor, exclusively or in combination with the application of human | |
| 16 | 16 | power; | |
| 17 | 17 | (B) cannot attain a speed of more than 20 miles | |
| 18 | 18 | per hour without the application of human power; and | |
| 19 | 19 | (C) has a motor that weighs less than [does not | |
| 20 | 20 | exceed a weight of] 100 pounds. | |
| 21 | 21 | SECTION 2. This Act takes effect September 1, 2009. |
