9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 84, Family Code, is amended by adding | |
11 | 11 | Section 84.007 to read as follows: | |
12 | 12 | Sec. 84.007. TESTIMONY BY CHILD. A child who is at least | |
13 | 13 | eight years of age and who is a member of the family or household for | |
14 | 14 | which protection is sought or on whose behalf the application for a | |
15 | 15 | protective order is filed may testify at a hearing on the | |
16 | 16 | application for a protective order. | |
17 | 17 | SECTION 2. Section 84.007, Family Code, as added by this | |
18 | 18 | Act, applies to a hearing on an application for a protective order | |
19 | 19 | held on or after the effective date of this Act, regardless of the | |
20 | 20 | date the application is filed. | |
21 | 21 | SECTION 3. This Act takes effect September 1, 2009. |
