| 7 | 7 | | relating to the proof of identity required of an applicant for a |

| 8 | 8 | | driver's license. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 521.142, Transportation Code, is amended |
|---|
| 11 | 11 | | by amending Subsections (a) and (e) and adding Subsections (d-1) |
|---|
| 12 | 12 | | and (d-2) to read as follows: |
|---|
| 13 | 13 | | (a) An application for an original license must state the |
|---|
| 14 | 14 | | applicant's full name and place and date of birth. This |
|---|
| 15 | 15 | | information must be verified by presentation of proof of identity |
|---|
| 16 | 16 | | that complies with Subsection (d-1) or (d-2), as applicable |
|---|
| 17 | 17 | | [satisfactory to the department]. If the applicant does not |
|---|
| 18 | 18 | | present such proof of identity, the department may not issue the |
|---|
| 19 | 19 | | license. [The department must accept as satisfactory proof of |
|---|
| 20 | 20 | | identity under this subsection an offender identification card or |
|---|
| 21 | 21 | | similar form of identification issued to an inmate by the Texas |
|---|
| 22 | 22 | | Department of Criminal Justice.] |
|---|
| 23 | 23 | | (d-1) If the application indicates that the applicant is a |
|---|
| 24 | 24 | | citizen of the United States, the applicant must provide to the |
|---|
| 25 | 25 | | department for inspection one of the following documents: |
|---|
| 26 | 26 | | (1) a birth certificate issued by: |
|---|
| 27 | 27 | | (A) an agency of the United States; or |
|---|
| 28 | 28 | | (B) a state or territory of the United States, or |
|---|
| 29 | 29 | | the District of Columbia; |
|---|
| 30 | 30 | | (2) a Certificate of United States Citizenship; |
|---|
| 31 | 31 | | (3) a Consular Report of Birth Abroad of a Citizen of |
|---|
| 32 | 32 | | the United States; |
|---|
| 33 | 33 | | (4) an unexpired United States passport; |
|---|
| 34 | 34 | | (5) a Certificate of United States Naturalization; |
|---|
| 35 | 35 | | (6) an unexpired United States Military |
|---|
| 36 | 36 | | Identification Card; or |
|---|
| 37 | 37 | | (7) a United States Citizen Identification Card. |
|---|
| 38 | 38 | | (d-2) If the application indicates that the applicant is not |
|---|
| 39 | 39 | | a citizen of the United States, the applicant must provide to the |
|---|
| 40 | 40 | | department for inspection one of the following documents: |
|---|
| 41 | 41 | | (1) a Permanent Resident Alien Card; |
|---|
| 42 | 42 | | (2) an unexpired passport issued by another country |
|---|
| 43 | 43 | | with "Processed for I-551" stamp; |
|---|
| 44 | 44 | | (3) a Permanent Resident Re-entry Permit; |
|---|
| 45 | 45 | | (4) an Arrival-Departure Form I-94 that bears the |
|---|
| 46 | 46 | | holder's photograph with "Temporary I-551" stamp; |
|---|
| 47 | 47 | | (5) a Travel Document issued to Permanent Residents; |
|---|
| 48 | 48 | | (6) a Travel Document issued to Refugees; or |
|---|
| 49 | 49 | | (7) a Form I-94 with "Asylee," "Parolee or Parole," |
|---|
| 50 | 50 | | "Refugee," "Asylum," "HP-Humanitarian Parolee," or "PIP-Public |
|---|
| 51 | 51 | | Interest Parolee" stamp. |
|---|
| 52 | 52 | | (e) The application must include any other information the |
|---|
| 53 | 53 | | department requires to determine the applicant's [identity,] |
|---|
| 54 | 54 | | competency[,] and eligibility. |
|---|
| 55 | 55 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 56 | 56 | | an application for a driver's license filed on or after the |
|---|
| 57 | 57 | | effective date of this Act. An application for a driver's license |
|---|
| 58 | 58 | | filed before the effective date of this Act is subject to the law in |
|---|
| 59 | 59 | | effect on the date of filing, and that law is continued in effect |
|---|
| 60 | 60 | | for that purpose. |
|---|
| 61 | 61 | | SECTION 3. This Act takes effect September 1, 2009. |
