55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the proof of identity required of an applicant for a
88 driver's license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 521.142, Transportation Code, is amended
1111 by amending Subsections (a) and (e) and adding Subsections (d-1)
1212 and (d-2) to read as follows:
1313 (a) An application for an original license must state the
1414 applicant's full name and place and date of birth. This
1515 information must be verified by presentation of proof of identity
1616 that complies with Subsection (d-1) or (d-2), as applicable
1717 [satisfactory to the department]. If the applicant does not
1818 present such proof of identity, the department may not issue the
1919 license. [The department must accept as satisfactory proof of
2020 identity under this subsection an offender identification card or
2121 similar form of identification issued to an inmate by the Texas
2222 Department of Criminal Justice.]
2323 (d-1) If the application indicates that the applicant is a
2424 citizen of the United States, the applicant must provide to the
2525 department for inspection one of the following documents:
2626 (1) a birth certificate issued by:
2727 (A) an agency of the United States; or
2828 (B) a state or territory of the United States, or
2929 the District of Columbia;
3030 (2) a Certificate of United States Citizenship;
3131 (3) a Consular Report of Birth Abroad of a Citizen of
3232 the United States;
3333 (4) an unexpired United States passport;
3434 (5) a Certificate of United States Naturalization;
3535 (6) an unexpired United States Military
3636 Identification Card; or
3737 (7) a United States Citizen Identification Card.
3838 (d-2) If the application indicates that the applicant is not
3939 a citizen of the United States, the applicant must provide to the
4040 department for inspection one of the following documents:
4141 (1) a Permanent Resident Alien Card;
4242 (2) an unexpired passport issued by another country
4343 with "Processed for I-551" stamp;
4444 (3) a Permanent Resident Re-entry Permit;
4545 (4) an Arrival-Departure Form I-94 that bears the
4646 holder's photograph with "Temporary I-551" stamp;
4747 (5) a Travel Document issued to Permanent Residents;
4848 (6) a Travel Document issued to Refugees; or
4949 (7) a Form I-94 with "Asylee," "Parolee or Parole,"
5050 "Refugee," "Asylum," "HP-Humanitarian Parolee," or "PIP-Public
5151 Interest Parolee" stamp.
5252 (e) The application must include any other information the
5353 department requires to determine the applicant's [identity,]
5454 competency[,] and eligibility.
5555 SECTION 2. The changes in law made by this Act apply only to
5656 an application for a driver's license filed on or after the
5757 effective date of this Act. An application for a driver's license
5858 filed before the effective date of this Act is subject to the law in
5959 effect on the date of filing, and that law is continued in effect
6060 for that purpose.
6161 SECTION 3. This Act takes effect September 1, 2009.
